Background
1. The Appellant filed his RTI application dt.30.5.08 with the CPIO, DLW, Varanasi. He requested for information against 4 points: i) the letter sent by the All India SC/ST Associations to the Central Committee recommending removal of two office bearers, ii) under which bye-laws the General Secretary, Mr. Mahane removed the two officers, iii) copies of complete documents in this regard and iv) decision taken by the working committee in which the restrictions have been imposed on expenditure by the present General Secretary. The CPIO replied on 2.7.08 annexing the reply received from the Personnel Branch providing point-wise information and also stating that the information against point (iii) and (iv) are not available in their office. Not satisfied with the reply, the Applicant filed an appeal dt.2.8.08 with the Appellate Authority requesting for complete information. The Appellate Authority wrote on 10.9.08 to the CPIO, Railway Board transferring the appeal to him and requesting him to provide the missing information. Aggrieved with the reply, the Applicant filed a second appeal dt.22.10.08 before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing for June 4, 2009.
3. Mr. Shivendra Mohan, Dy. GM & Secy. to GM cum PIO represented the Public Authority.
4. The Applicant was not present during the hearing.
Decision
5. The Respondent submitted that after having filed the present RTI request, the Appellant had also applied to the Railway Board for the same information and the Railway Board provided information covering points No.(iii) and (iv) vide their letter No. RTI Cell/2008/444 dated 19.6.08. The Commission, on reviewing the information provided, noted that between DLW Varanasi and the Railway Board, all available information has been provided to the Appellant, in response to the Appellant's two RTI requets .
6. The appeal is accordingly disposed of.
