1. Mr. Hemant Choudhary, learned counsel for the State submits that the State is responsible only to the extent of 70% of the amount determined by the Tribunal pursuant to its order dated 19.01.2009.
2. He asserts that in pursuance of the order aforesaid, the State has deposited a sum of Rs.7,16,175/- in bank account of the respondent-school, as is evident from letter dated 07.06.2006 (at page No.46).
3. Learned counsel submits that in spite of the fact that the amount has been deposited and the same is lying in bank account of the respondent-school, the Tribunal is taking action against the petitioners in the execution proceedings. (Downloaded on 10/08/2021 at 09:02:15 PM)

4. Matter requires consideration.
5. Issue notice. Issue notice of stay application also, returnable within six weeks.
6. Meanwhile, no coercive action shall be taken against the State or it's officers in the Execution Case No.55/2009.
7. Needless to observe that if the assertion made by Mr. Choudhary is correct and amount deposited is lying in the Bank account of the respondent-school, the Tribunal may take appropriate proceedings for disbursing the deposited amount to respondent No.2 in accordance with law.
