Sanjay Karol, Acting Chief Justice (Oral) Petitioner prayed for the following reliefs:

"a) That in the facts and circumstances narrated in the Civil Writ Petition, respondent No.1 to 3 be directed to close Excise Unit No.2, Mall road (CTO) opened in main mall road market in business area of Excise Unit No.1 L-2 Mall road (M) and directed respondent No.4 to open his vend at the place of its auction and allotment i.e. near CTO/Deputy Commissioner Office Shimla.
b) That respondent be directed to compensated petitioner for financial/business loss and injury caused to petitioner on account of ::: Downloaded on - 19/06/2018 23:02:27 :::HCHP 2 opening of Excise Unit L-2 Mall Road (CTO) in the area of its business as Unit No.1 Mall road (CTO) in the area of its business as Unit No.1 Mall Road .
(M) Shimla."

2. It is a common case of the parties that prayer clause (a) has become infructuous. Insofar as prayer clause (b) is concerned, learned counsel for the petitioner seeks permission to withdraw the petition, reserving liberty to initiate appropriate proceedings, in accordance with law, if so required and desired. Permission granted.

Liberty reserved.

In view of the above, petition stands disposed of as withdrawn, alongwith pending application(s), if any.
