Petitioner prays for bail pending trial in a criminal case arising out from FIR No.0006, dated 16.11.2018, registered under Sections 482/483 IPC and Section 18 of the NDPS Act, at Police Station State Special Operations Cell, SAS Nagar, District Intelligence Wing (CID).

As per the case of the prosecution, petitioner along with his co- accused were found in conscious possession of 10 kg opium, when the car was stopped at barrier by the Deputy Superintendent of Police.

Learned counsel for the petitioner submits that the petitioner is only owner-driver of the cab and the main accused, who are habitual offenders had hired his vehicle. He, hence, submits that the petitioner cannot be said to be in conscious possession of the narcotics.

On the other hand, learned counsel for the State, on instructions from SI Ravinder Singh, while referring to the investigation carried out, has submitted that the petitioner allegedly purchased vehicle No.HR-06-T-4452 registered at Panipat in the year 2009 and got a new number allotted from Punjab i.e. bearing No.PB-08-AH-4101. However, at the time when he was 1 of 2 ::: Downloaded on - 20-01-2020 05:52:54 ::: CRM-M-47694-2019(O&M) -2- caught, he was still displaying the old number i.e. the previous number issued by the Registration Authority, Panipat, even after 9 years. He further submits that the recovery in the present case is huge and the police is making sincere attempt to curb this menace.

Keeping in view the facts of the case, this court is not inclined to grant concession of bail to the petitioner.

Dismissed.
