The Respondent as complainant filed a complaint before the District Forum against the Appellant / opposite party, praying for the direction to the opposite party to pay Rs.1 lakh towards damages, alongwith cost of Rs.3000/-. The District Forum allowed the complaint. Against the said order, this appeal is preferred praying to set aside the order of the District Forum dt.20.10.2005 in COP No.119/2002.

 

This petition coming before us for hearing today. A joint memo of compromise has been filed, in view of that memo this commission made the following order in the open court:

1. Parties have filed compromise memo, settling the matter between themselves, under which the complainant/ respondent, in this appeal had agreed to receive Rs.35000/- in full quit of the entire award amount, out of which, he had received a sum of Rs.6000/-, agreeing to receive the mandatory deposit with accrued interest, which would satisfy the rest of the claim viz.

Rs.29000/-. The learned counsel for complainant, also represented, that even if the amount is less than Rs.29000/-, or more than Rs.29000/-, parties have agreed to settle the matter, thereby not creating any problem. Compromise recorded.

 

2. Pursuant to the compromise recorded, the appeal is dismissed, as settled out of commission. Registry is directed to handover the Fixed Deposit Receipt, with accrued interest, made by way of mandatory deposit, to the respondent/complainant, duly discharged, in his favour.
