Section 39(1) in The Narcotic Drugs And Psychotropic Substances Rules, 1985
(1)A person who has been issued a licence under rule 36 or rule 36A or rule 37 shall not commence manufacture without obtaining the licences required under the Drugs and Cosmetics Act, 1940 (23 of 1940) for the manufacture of the drug, and the rules framed under section 10 of the Act by State Government of the State in which he has his place of business, for the possession, sale and distribution of the drug.
