1. The Appellant filed RTI application dated 15.05.2023 seeking information regarding letter no. 25/30/2023-IAF.II dated 21 April 2023 issued by Finance Ministry on the following points:

1.2 Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 05.07.2023. The FAA vide order dated 04.08.2023 directed the CPIO to provide certified documents related to RTI query as provision of RTI Act, 2005. 1.3 Aggrieved with the FAA's order, the Appellant approached the Commission with the instant Second Appeal dated 24.09.2023. 2. The Appellant filed an RTI application dated 10.04.2023 seeking information regarding a letter issued by Wonder Home Finance Limited, dated 30.03.2023 on the following points:
(i) "यह क वंडर होम फाइन<स िलिमटेड /ारा दनांक 30.03.2023 को ाथF के नाम से धमक भरे प (आपरािधक अपराध बताते 8ए) जारी करने वाले/ ेिषत करने वाले अिधकारी/कम.चारी / लोकसेवक का पूरा नाम,, पदनाम बताते 8ए उससे संबंिधत सूचना मािणत ितय! म< उपल;ध कराव<।

2.1 The CPIO replied vide letter dated 13.05.2023 and the same is reproduced as under:-
"Point (i) - रा.आ.ब=क के पास उपल;ध सूचना के अनुसार, आवास िवK कं पिनय! क िशकायत! के िलए संपक. Bबंद/ु नोडल अिधकारी िववरण रा.आ. ब=क क वेबसाइट https://nhb.org.in/wp- content/uploads/2023/02/list.pdf पर उपल;ध है।
Point (ii) & (iii) - आवेदक /ारा मांगी गई सूचना का रा.आ. ब=क /ारा अनुरLण नहM कया जाता है। इसिलए, रा. आ. ब=क के पास दान करने के िलए कोई जानकारी नहM है।
Point (iv) & (v) - ये उनक आंतHरक नीितय! के आधार पर आ.िव.क. के Nावसाियक िनण.य ह=, जो ऋणदाता और उधारकता. के साथ कए गए ऋण समझौते /ारा शािसत होते ह=, इसिलए रा.आ. ब=क इस संबध ं म< कोई भी जानकारी तुत करने क ि थित म< नहM है। ...etc. Page 5 of 47 2.2 Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 19.05.2023. The FAA vide order dated 21.06.2023 directed the CPIO to provide copy of earlier reply to the appellant as provision of RTI Act, 2005. 2.3 Aggrieved with the FAA's order, the Appellant approached the Commission with the instant Second Appeal dated 25.07.2023. 3. The Appellant filed an RTI application dated 14.02.2023 seeking information regarding complaint letter dated 15.12.2022 addressed to National Housing Bank on the following points:
(i) "यह क उ अ ेिषत कये गये प ! क ितयां मय संल कये गये द तावेज! क ितयां।
(ii) यह क उ अ ेिषत कये गये प ! को डाक आवक जावक रिज टर के िजस-िजस पृ* पर इ+,ाज कया गया। उन पृ*! क ितयां।
(iii) यह क उ अ ेिषत कये गये प ! पर आपके िवभाग / काया.लय /ारा चलाई गई सम त नोटशीट! क ितयां।
(iv) यह क संबंिधत सम त प ाविलय! के आगे व पीछे के फाईल कवर! क ितयां।

3.1 The CPIO replied vide letter dated 17.03.2023 and the same is reproduced as under:-
"Point (i) to (v) - िशकायत सं7या N202223023333539 और िशकायत आईडी 03028033 वाली िशकायत भारतीय Hरज़व. ब=क क िशकायत बंधन णाली (सीएमएस) पर ा> 8ई थी और सूचना दनांक 01/01/2023 के ईमेल के माCयम से ा> 8ई थी। िशकायत म< िशकायत का Page 6 of 47 मूल 'भौितक प '' के @प म< उOलेख कया गया था। हालां क,, िशकायत के साथ संल कोई प ा> नहM 8आ इसके अितHर ,, िनवारण के िलए आवQयक जानकारी अपया.> थी। इसिलए राJीय आवास ब=क समाधान के िलए िशकायत पर िवचार करने म< असमथ. था। राJीय आवास ब=क क िशकायत िनवारण नीित के अनुRछेद 6.2(i) और 6.2 (viii) के अनुसार,, "िशकायत " प और िशकायत म< िनधा.Hरत अपूण.
अिनवाय. िववरण! के साथ ा>/पंजीकृ त िशकायत<, िजसे अधूरा/मनमाना/अ पT या तंग करने वाला हो या िबना कसी पया.> कारण के दायर कया गया हो या िजसम< िनण.य/नीित शािमल हो िजससे िशकायतकता. UयL/अ UयL @प से भािवत नहM होता है I"
3.2 Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 21.03.2023. The FAA vide order dated 17.04.2023 directed the CPIO to provide copy of earlier reply to the appellant as provision of RTI Act, 2005.
3.3 Aggrieved with the FAA's order, the Appellant approached the Commission with the instant Second Appeal dated 06.05.2023.

4. The Appellant filed an RTI application dated 10.02.2023 seeking information on the following points:
(i) "यह क आधार हाऊBसंग फायन<स िलिमटेड एवं वंडर होम फायन<स के रिज Wेशन कराने के संबंध म< आपके िवभाग/काया.लय को ेिषत कये गये ाथ.ना प ! गय संल कये गये द तावेज! क मािणत ितयां उपल;ध कराव<।

(iv) यह क आधार हाऊBसंग फायन<स िलिमटेड एवं वंडर होम फायन<स का रिज Wेशन करने के संबंध म< आपके िवभाग/काया.लय /ारा जो Xया अपनायी गई है उस Xया से संबंिधत सIपूण. सूचना मािणत ितय! म< उपल;ध कराव<।
(v) यह क आधार हाऊBसंग फायन<स िलिमटेड एवं वंडर होम फायन<स का रिज Wेशन आपके िवभाग / काया.लय /ारा िजस िनयम, कानून, ावधान, आदेश एवं पHरप के आधार पर कया गया है उस िनयम, कानून, ावधान, आदेश एवं पHरप क मािणत ितयां उपल;ध कराव<।" ...etc. 4.1 The CPIO replied vide letter dated 15.03.2023 and the same is reproduced as under:-
"Point (i) - सूचना का अिधकार अिधिनयम, 2005 क धारा 8 (1) (ई) के अनुसार, मांगी गई जानकारी साव.जिनक ािधकरण (रा.आ. ब=क) /ारा Uययी Lमता म< रखी जाती है और उपयु. जानकारी के कटीकरण से कोई जनिहत संबंिधत नहM है। इसिलए, रा.आ. ब=क के पास दान करने हेतु कोई जानकारी उपल;ध नहM है।
Point (ii) - आवेदक /ारा मांगी गई जानकारी वैयि क जानकारी से संबंिधत है, िजसके कटीकरण का कसी साव.जिनक गितिविध या िहत से कोई संबध ं नहM है, और इससे Nि क गोपनीयता का अनुिचत अितXमण होगा। चूं क सूचना का अिधकार अिधिनयम, 2005 क धारा 8 (1) (जे) के अनुसार, इसके कटीकरण के िलए कोई बड़ा साव.जिनक िहत वारं ट नहM है, रा.आ. ब=क के पास दान करने हेतु कोई जानकारी उपल;ध नहM है।
Point (iii) & (v) - आधार हाउBसंग फाइन<स िलिमटेड को पंजीकरण माणप (सीओआर) सं. 04.0168.18 दनां कत 05-04-2018 को राJीय आवास ब=क अिधिनयम, 1987 क धारा 29क के Page 8 of 47 तहत सीओआर म< उिOलिखत शतZ के अनुसार दान कया गया था। सीओआर क ित अनुबंध-1 म< संल है। चंडर होम फाइन<स िलिमटेड को पंजीकरण माणप (सीओआर) सं. 05.0171.18 दनां कत 29-05-2018 राJीय आवास ब=क अिधिनयम, 1987 क धारा 29क के तहत साव.जिनक जमा क वीकृ ित के िलए मा+य नहM है, जो क सीओआर म< उिOलिखत शतZ के अनुसार है। सीओआर क ित अनुबंध 2 म< संल है।
Point (iv) - िवKीय सेवाएं िवभाग, िवत मं ालय क अिधसूचना सं. S.O.2902 (E) दनां कत 09.08.2019 के अनुसार, सभी आवास िवत कं पिनय! (आ.िव.क.) के िविनयमन को भारतीय Hरजव. ब=क को थानांतHरत कर दया गया है। हालां क, यथा 08-08- 2019 को आवास िवत कं पिनय! के पंजीकरण माणप (सीओआर) हेतु आवेदन प अनुबंध 3 संल है।" ...etc. 4.2 Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 17.03.2023. The FAA vide order dated 17.04.2023 directed the CPIO to provide copy of earlier reply to the appellant as provision of RTI Act, 2005. 4.3 Aggrieved with the FAA's order, the Appellant approached the Commission with the instant Second Appeal dated 28.04.2023. 5. The Appellant filed an RTI application dated 10.01.2023 seeking information on the following points:

5.1. The CPIO replied vide letter dated 10.02.2023 and the same is reproduced as under:-

आवेदक ने उpेख िकया िक िशकायत संnा N202223023336014 और N202223023333911 वाली िशकायत: रा.आ. बक ारा भारतीय रज़व बक की िशकायत बंधन णाली से संलc और संपक पते के िबना ा oई थीं। चूंिक िनवारण के िलए आवRक जानकारी अपया थी, रा.आ. बक समाधान के िलए िशकायत/िशकायतों को ोसेस करने म: असमथ था।

5.2. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 20.02.2023. The FAA vide order dated 24.03.2023 upheld the reply given by the CPIO.

17.2. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 06.04.2023. The FAA vide order dated 03.05.2023 stated that:
"चूंिक सीपीआईओ ने पहले ही आरटीआई आवेदन काजवाब दे िदयाहै , इसिलए थम अ पील िनÈल हो गई है । हालांिक, अ पीलकताके इस तक के मÉे नजर िक उसे आरटीआई आवेदन काजवाब नहीं िमलाहै , सीपीआईओ को िनद¬ श िदयाजाताहैिक वह इस आदे श की ा के 7 िदनों के भीतर िकसी भी §ीकाय तरीके से अ पीलकताको आरटीआई के जवाब की एक ित अ Xेिषत करे ।

18. The Appellant filed an RTI application dated 15.02.2023 seeking information on the following points:

19. The Appellant filed an RTI application dated 14.02.2023 seeking information on the following points:

"1:जै सािक मांगी गई जानकारी रा.आ. बक ाराअपने सामा‚ ©वसाय के दौरान संकिलत नहीं की जाती है और यह सावजिनक ािधकरण के संसाधनों को असं गत 5प से भािवत करे गा, उ[ को आरटीआई अिधिनयम, 2005 की धारा7 (9) के तहत छूट दान की गई है । अतः रा.आ.बक के पास उपलa करवाने के िलए कोई जानकारी नहीं है ।
हालांिक, 28-02-2023 तक, वंडर होम फाइन:स िलिमटे ड के पास 9,387 ऋण खाते बकाया थे और आधार हाउिसंग फाइन:स िलिमटे ड के पास 2,29,157 ऋण खाते बकायाथे ।

19.2. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 22.03.2023. The FAA vide order dated 21.04.2023 stated that:
"चूंिक सीपीआईओ ने पहले ही आरटीआई आवेदन काजवाब दे िदयाहै , इसिलए थम अपील िनÈल हो गई है । हालांिक, अपीलकताके इस तक के मÉे नजर िक उसे आरटीआई आवेदन Page 38 of 47 का जवाब नहीं िमला है , सीपीआईओ को िनद¬ श िदया जाता है िक वह इस आदे श की ा के 7 िदनों के भीतर िकसी भी §ीकाय तरीके से अ पीलकता को आरटीआई के जवाब की एक ित अ Xेिषत करे ।

19.3. Aggrieved with the FAA's order, the Appellant approached the Commission with the instant Second Appeal dated 08.05.2023.
Hearing Proceedings & Decision
20. The Appellant remained absent during the hearing (although he had marked his presence in an earlier matter heard simultaneously with the instant set of cases), however, an Advocate attended the hearing for the last lot of 9 odd cases and identified herself as Advocate Shubhangi Singh. While, on behalf of the respondent, Aditya Sharma, CPIO & DGM; Mahabir Singh Kasana, Advocate along with Rahul K Meena, AM, RTI Cell were present during the hearing in person.
21. The Advocate allegedly representing the Appellant (who was present in the NIC premises but absented himself during the hearing) was offered an opportunity to plead the cases, however, she misrepresented the facts of the cases and frantically flipped over a gamut of papers only to plead that she was assigned with the case only this morning and therefore requests for an adjournment. The bench reprimanded the advocate for wasting the time and resources of the Commission by firstly appearing towards the end of the hearing proceedings and for displaying no knowledge of the facts of the cases sought to be represented by her. It was informed to the Advocate that her conduct and request for adjournment was unacceptable and that the cases will be decided on merits.
22. The Respondent reiterated the replies provided to the Appellant and emphasized on the submissions made in the connected matter heard previously vide Second Appeal No. Page 39 of 47 CIC/DOFSR/A/2023/130639 stating that - 'the Appellant has been filing repetitive RTI Application(s) and appeal(s), so far about 20 in number; raising around 16 -18 points in each of these RTI Application(s) predominantly concerning his grievance related to housing loan. The CPIO further harped on the overview of the nature of queries ordinarily raised by the Appellant through his RTI Application(s), which allegedly were said to be containing the use of unparliamentary language as well.'
23. The Commission after adverting to the facts and circumstances of the case, and perusal of records, observes that the instant set of matters are a mere extension of the connected matters heard vide Second Appeal No. CIC/RBIND/A/2023/141252 + 5 appeal(s) as well as Second Appeal No. CIC/DOFSR/A/2023/130639. The following observation of the bench in the averred RBI matters may be read for clarity:
"The Commission after adverting to the facts and circumstances of the instant set of cases, observes at the outset that these relate to RTI Application(s) seeking to know simpliciter action taken details on various letter(s)/complaints/legal notices etc. of the Appellant, emanating from what appears to be a grievance against the Appellant being served with home loan repayment default notice; change in the levied rate of interest; causing detriment to his CIBIL score etc. However, under the garb of seeking for information, it appears that the Appellant is aiming to vindicate his grievance and mortify the CPIOs for the action/inaction of the public authority as the RTI Application(s) have been framed in the most cumbersome manner with a hysterical undertone asking for unspecific records; largely worded beyond the limit prescribed under Rule 3 of RTI Rules, 2012. In other words, the RTI Application(s) under reference harping excessively on conjecture, could have been a simple single query wanting to know the action taken on the respective communication(s). Nonetheless, the Respondent has duly replied to each of these RTI Application(s) in keeping with the letter and spirit of the RTI Act, while also invoking the appropriate exemption clauses of Section 8 of the RTI Act, wherever applicable..."
Now, through the instant RTI Application(s), the Appellant has raised either similar action taken queries extrapolated into a dozen odd queries or has sought to challenge the Page 40 of 47 inaction of NHB officials who allegedly issued him with the demand notice or seeks to question the registration of a housing finance company; hypothesizing about social audit carried out by NHB or wanting to know all and sundry details of the entirety of the home loan customers; incoherent data on all kinds of home loans sanctioned etc. by raising clarificatory queries. Now, despite the fact that none of these RTI Applications warranted the CPIO to comprehend the incoherence or unspecific and clarificatory queries, yet, the CPIO has provided point-wise suitable replies incorporating the available information, in keeping with the spirit of the RTI Act.
24. Adverting to the foregoing observations, the Appellant is reminded of the fact that his right to information is far from being absolute and unconditional. That, it is rather unfortunate that even the best of intentions has to not only stand the test of procedural requirements and fetters laid down in the RTI Act but also stand the test of practicality, a notion well recognised by the superior Courts in a catena of judgments such as the Hon'ble Supreme Court's observation in the matter of Central Board of Secondary Education (CBSE) & Anr. v. Aditya Bandhopadhyay and others [(2011) 8 SCC 497] stating that:
'37. The right to information is a cherished right. Information and right to information are intended to be formidable tools in the hands of responsible citizens to fight corruption and to bring in transparency and accountability. The provisions of RTI Act should be enforced strictly and all efforts should be made to bring to light the necessary information under clause (b) of section 4(1) of the Act which relates to securing transparency and accountability in the working of public authorities and in discouraging corruption. But in regard to other information,(that is information other than those enumerated in section 4(1)(b) and (c) of the Act), equal importance and emphasis are given to other public interests (like confidentiality of sensitive information, fidelity and fiduciary relationships, efficient operation of governments, etc.). Indiscriminate and impractical demands or directions under RTI Act for disclosure of all and sundry information (unrelated to transparency and accountability in the functioning of public authorities and eradication of corruption) would be counter-productive as it will adversely affect the Page 41 of 47 efficiency of the administration and result in the executive getting bogged down with the non- productive work of collecting and furnishing information. The Act should not be allowed to be misused or abused, to become a tool to obstruct the national development and integration, or to destroy the peace, tranquility, and harmony among its citizens. Nor should it be converted into a tool of oppression or intimidation of honest officials striving to do their duty. The nation does not want a scenario where 75% of the staff of public authorities spends 75% of their time in collecting and furnishing information to applicants instead of discharging their regular duties. The threat of penalties under the RTI Act and the pressure of the authorities under the RTI Act should not lead to employees of a public authorities prioritizing 'information furnishing', at the cost of their normal and regular duties.'
25. Similarly, for better understanding of the mandate of the RTI Act, the Appellant shall note that outstretching the interpretation of Section 2(f) of the RTI Act to include deductions and inferences to be drawn by the CPIO is unwarranted as it casts immense pressure on the CPIOs to ensure that they provide the correct deduction/inference to avoid being subject to penal provisions under the RTI Act. For the sake of clarity, the provision of Section 2(f) of the RTI Act is reproduced hereunder:
"2. Definitions.--In this Act, unless the context otherwise requires,--
(f) "information" means any material in any form, including records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force;.."
In this regard, the Appellant's attention is drawn towards a judgment of the Hon'ble Supreme Court on the scope and ambit of Section 2(f) of RTI Act in the matter of CBSE vs. Aditya Bandopadhyay & Ors.[CIVIL APPEAL NO.6454 of 2011] wherein it was held as under:
Page 42 of 47"35. At this juncture, it is necessary to clear some misconceptions about the RTI Act. The RTI Act provides access to all information that is available and existing.........A public authority is also not required to furnish information which require drawing of inferences and/or making of assumptions. It is also not required to provide `advice' or `opinion' to an applicant, nor required to obtain and furnish any `opinion' or `advice' to an applicant. The reference to `opinion' or `advice' in the definition of `information' in section 2(f) of the Act, only refers to such material available in the records of the public authority. Many public authorities have, as a public relation exercise, provide advice, guidance and opinion to the citizens. But that is purely voluntary and should not be confused with any obligation under the RTI Act." (Emphasis Supplied) Similarly, in the matter of Khanapuram Gandaiah vs Administrative Officer &Ors. [SLP (CIVIL) NO.34868 OF 2009], the Hon'ble Supreme Court held as under:
"7....Public Information Officer is not supposed to have any material which is not before him; or any information he could have obtained under law. Under Section 6 of the RTI Act, an applicant is entitled to get only such information which can be accessed by the "public authority" under any other law for the time being in force. The answers sought by the petitioner in the application could not have been with the public authority nor could he have had access to this information and Respondent No. 4 was not obliged to give any reasons as to why he had taken such a decision in the matter which was before him...."
(Emphasis Supplied) And, in the matter of Dr. Celsa Pinto, Ex-Officio Joint Secretary, (School Education) vs. The Goa State Information Commission [2008 (110) Bom L R 1238], the Hon'ble Bombay High Court held as under:
"..... In the first place, the Commission ought to have noticed that the Act confers on the citizen the right to information. Information has been defined by Section 2(f) as follows.

Section 2(f) -Information means any material in any form, including records, documents, memos e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force;
The definition cannot include within its fold answers to the question why which would be the same thing as asking the reason for a justification for a particular thing. The Public Information Authorities cannot expect to communicate to the citizen the reason why a certain thing was done or not done in the sense of a justification because the citizen makes a requisition about information. Justifications are matter within the domain of adjudicating authorities and cannot properly be classified as information."

26. The findings of the Commission in the instant set of matter(s) additionally point towards a potential misuse of the RTI Act by the Appellant. Here, the Appellant's attention is again invited towards certain precedents set by the superior Courts recognizing the misuse of the RTI Act:
In ICAI v. Shaunak H. Satya, (2011) 8 SCC781, the Hon'ble Supreme Court has held that:-
'39. We however agree that it is necessary to make a distinction in regard to information intended to bring transparency, to improve accountability and to reduce corruption, falling under Sections 4(1)(b) and (c) and other information which may not have a bearing on accountability or reducing corruption. The competent authorities under the RTI Act will have to maintain a proper balance so that while achieving transparency, the demand for information does not reach unmanageable proportions affecting other public interests, which include efficient operation of public authorities and the Government, preservation of confidentiality of sensitive information and optimum use of limited fiscal resources.' Page 44 of 47 In the matter of Rajni Maindiratta- Vs Directorate of Education (North West - B) [W.P.(C) No. 7911/2015] the Hon'ble High Court of Delhi has held that:
'8. Though undoubtedly, the reason for seeking the information is not required to be disclosed but when it is found that the process of the law is being abused, the same become relevant. Neither the authorities created under the RTI Act nor the Courts are helpless if witness the provisions of law being abused and owe a duty to immediately put a stop thereto.' And, in the matter of Shail Sahni vs Sanjeev Kumar [W.P.(C) 845/2014] the Hon'ble High Court of Delhi has held that:
'...xxx 'This Court is also of the view that misuse of the RTI Act has to be appropriately dealt with, otherwise the public would lose faith and confidence in this "sunshine Act". A beneficent Statute, when made a tool for mischief and abuse must be checked in accordance with law.'
27. The Appellant is therefore strongly advised to desist from filing repetitive RTI Applications on the same grievance as his future appeals/complaint on the same matter are liable to be summarily dismissed. The Respondent is also advised to take reference of the instant decision while dealing with any future RTI Application(s) of the Appellant on the same subject matter.
28. The Appeal(s) are dismissed accordingly.
29. The instant order additionally dismisses two similar appeal(s) filed by the Appellant against the Respondent vide Second Appeal No. CIC/NHBNK/A/2023/122751 and CIC/NHBNK/A/2023/129763.
