Order No. 05 Dated 06th January, 2025 Heard the learned counsel for the respective sides. The petitioner apprehends his arrest in connection with R.C. Case 53(S)/2017(R).
It has been alleged that the officials of M/s. Eris Energy Ltd. and M/s. Eris Commotrade Pvt. Ltd. have got invested a huge amount of money from the general public and have not returned the said amount on maturity.
Submission has been advanced by the learned counsel for the petitioner that the petitioner is merely a Director of M/s. Eris Energy Ltd. and M/s. Eris Commotrade Pvt. Ltd. It has further been submitted that charge sheet has already been submitted by the CBI which would reveal that no amount was withdrawn by the petitioner.
Mr. Anil Kumar, learned ASGI has opposed the prayer for anticipatory bail of the petitioner.
Regard being had to the fact that the CBI has already submitted charge sheet, I am inclined to grant the privilege of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender before the learned trial court within four weeks from today and on such surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M.-cum-Special Judicial Magistrate, CBI, Dhanbad in connection with R.C. Case 53(S)/2017(R), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This application stands allowed.
