(Order of the Court was made by S.Manikumar,J) http://www.judis.nic.in 3 Claiming himself to be a public interest litigant, petitioner has sought for a writ of certiorarified mandamus, to quash an order, dated 1/7/2018, passed in Na.Ka.No.7539/2010 No.2, by which the District Collector, Kancheepuram, has granted permission to the Corporation of Chennai, to provide graveyard exclusively to the Muslim community, land comprising in S.No.6/2, measuring an extent of 0.24.5 hectares out of a total extent of 2.20.0 hectares, Injambakkam Village, as per the sketch annexed to the said order.

2. Petitioner has contended that in Injambakkam Village, Kancheepuram District, Corporation Ward No.198, along with east coast road, there are about 30,000 Hindus. Government of Tamil Nadu allotted an extent of 2.20.0 hectares or about 5 1/2 acres of land, comprised in S.No.6/2, for the purpose of burial ground and cemetery for Hindus residing in the said Village. The said burial ground has been exclusively used for burying/cremating Hindus for more than 200 years.

Hindus belong to different communities. Petitioner has contended that Muslim bury the dead. For the Muslims in Injambakkam Village, there are three burial grounds, in Palavakkam, Panaiyur and recently, in J J http://www.judis.nic.in 4 Nagar, Thoraipakkam, on the western side of the canal about 500 meters from the east coast road. The above burial grounds are within 2 to 3 Kms radius from Injambakkam village. 2 acres of land has been allotted in J.J Nagar, for the Muslims of Injambakkam. According to the petitioner, Muslim population in Injambakkam is about less than 100 families compared to a huge population of 3000 Hindus. Petitioner has further contended that on the request of Muslim community, the District Collector, has granted permission, despite the objections of Hindus, failure of the Peace Committee Meeting of both the religions. Petitioner has further contended that location of burial ground would cause communal and religious problems.

3. Heard Mr.R.Amizhthu, learned counsel for the petitioner, Mr.E.Manoharan, learned Additional Government Pleader for the respondents 1, 2, 4 to 6 and Mr.K.Soundarajan, learned Standing Counsel for the third respondent and perused the materials available on record.

4. Based on the averments, Mr.R.Amizhthu, learned counsel for the petitioner made submissions. He further submitted that the impugned order at one stage states that there is objection and at http://www.judis.nic.in 5 another states that there is no objection.

Before adverting to the material on record and the submissions of the learned counsel for the petitioner, this Court deems it fit to extract few passages from the judgment of this Court, made in W.P.(MD) No.8723 of 2015, dated 16/6/2015 {P.Joseph Raj Vs. 1. The District Collector, Dindigul District and4 others}, to which one of us is a party (The Hon'ble Mr.Justice S.Manikumar).

“13.Kith and kin of the bereaved family would wish R.I.P., meaning “Rest in Peace”. Those who miss their beloved may even wish R.I.P., to be read as “Return if possible”. But the Great Poet Thiruvalluvar says:

The English meaning of the above said Thirukural by Rev.G.U.Pose is extracted here under:
“Existing yesterday, to-day to nothing burled!- Such greatness owns this transitory world”.
Graveyard is a place to rest. We wish the dead, R.I.P., but on the facts and circumstances of this case, we could see that there is no peace for the living. When there is a http://www.judis.nic.in 6 casteless society in many countries, is there any cure for this chronic disease, caste? On the facts, the bereaved have no place to bury the dead body.
14.The Great Poet Thiruvalluvar further says:
“epy;yh jtw;iw epiyapd btd;WzUk;
g[y;ywp th;zik fil”.
Meaning: epiyapy;yhjitfis epiyahdit vd;W czUk; g[y;ywpt[ cilatuhf ,Uj;jy; thH;f;ifapy; ,Hpe;j epiyahFk;.
The English meaning of the above said Thirukural by Rev.G.U.Pose is extracted here under:
“Lowest and meanest lore, that bids men trust secure, In things that pass away, as things that shall endure”.
15.After going through the materials, we express our displeasure on the attitude of the villagers, who have separate burial grounds, depending upon their castes. A reminder of a native American Proverb “When you were born, you cried and the world rejoiced. Live your life in a manner so that when you die, the world cries and you rejoice”. Even after death, caste and factionalism, have given rise to law and order situation. Christianity has no caste system. What is prevalent and practiced in Hinduism appears to have been percolated into the above said religion. Whether “Holy Bible” allows this practice! It is left to the conscience of the practitioners, who seek pride http://www.judis.nic.in 7 in having their caste tags. Even for a decent burial, one has to fight for a place, officials have to visit the place, Peace Committee to be conducted and ultimately to litigate. During lifetime, people fight for rights, customary, personal or property, etc. We are pained to see that even after death, the fight continues for burial.

Religious belief and customs may vary in the matter of disposal of dead bodies. The place of burial is visited by family members and friends, as a mark of respect and to pay tributes. At this juncture, we deem it fit to extract a passage from a Judgment of our Brother Hon'ble Mr.Justice K.Chandru, in W.P(MD)No.3855 of 2005:

“The petitioner must be reminded of an yester year popular cinema song which beautifully summarised the burning ghat as the only place where total equality between communities exist. It may be quoted verbatim for the benefit of the petitioner and his community so that they may give up a separate enclosures within the public grave yard/cremation ground.

http://www.judis.nic.in 8 In the above writ petition, the petitioner therein was a President and Nattanmai of Arya Vaisya Community in Madurai. He challenged an order passed by the Commissioner of Police, Madurai, cancelling an agreement entered into between the said community and the Corporation, in allotting a separate cremation yard, for the purpose of burning the dead bodies, belonging to the members of the petitioner's community. While dismissing the writ petition, the learned Judge has made the said observation.
16.We may add one more lyric:

17.In metropolis, even the place is not available. In metropolis, where there is no space, burial grounds are converted into electric crematoriums. Perhaps in this village, as plenty of space is available, each section of the society, has a separate burial ground.
18.We may also add paragraphs 9 and 10 from the Judgment in W.P(MD)No.10782 of 2006 dated 14.08.2012 (Paul Thankom vs. Secretary to Government Home Department, State of Tamil Nadu, Fort St. George, Chennai and six others) ''9.Nobody shuns a doctor, or staff or even an http://www.judis.nic.in 9 employee, who cleans up a patient, in a hospital, on the grounds of caste, creed or religion. Differences though exist, nobody would ever think of it. Blood transfused in a hospital is not segregated on the basis of caste, creed or religion. Nor the person who requires blood, would ever demand blood only from a person belonging to his caste, community, creed or religion. If for his survival and existence a person can consciously believe and accept that all are equal, irrespective of caste, creed, community or religion, then why this hatred and division. Organs are transplanted. Blood and body have no religion or caste.

When the blood and organs of a Hindu can save a Muslim or vice versa or even a christian then why this intolerance. Is there not a similarity in 'Om', "Amen and "Ameen?". All religions aim at the same destination. Forms and practices may differ. One should not forget that our glorious constitution enshrines, secularism, fraternity and equality. Unity in diversity is our strength.

10.Before parting with the case, this Court wishes to reproduce the words of the Hon'ble Apex Court.

"Our tradition teaches tolerance; Our philosophy preaches tolerance; Our Constitution practices tolerance; Let us not dilute it".''
20.Before we part with, we wish to state our “Magna Carta”. The Constitution of India seeks to achieve, JUSTICE, social, economical and political; LIBERTY of thought, expression, belief, faith and worship; EQUALITY of status and of opportunity; and to promote among them all http://www.judis.nic.in 10 FRATERNITY assuring the dignity of the individual and the [unity and integrity of the Nation].
Society is infected with deadly viruses, like castism, communalism and so on and so forth. Viruses have found a permanent place in mind. This is a classic case, as to how people fight, even for burial of dead bodies, forgetting for a moment that our body is:
“fhank ,J bgha;alh btWk; fhw;wilj;j igalh” We only pray that our religious heads, to address the mass, equality, fraternity and brotherhood.
6. Material on record discloses that when a request for allotment of grave yard by Muslim Jamath was made for burying dead bodies, Tahsildar, Sholinganallur, has written a letter in R.C.No.6684/2009/A2 dated Nil/5/2017, to the Zonal Officer, Zone 15, Greater Corporation of Chennai, requesting him to send a copy of the resolution for allotment of land comprised in S.No.6/2 to Muslim Community for burying dead bodies.
7. Responding to the same, Greater Chennai Corporation, passed Resolution No.757/17, dated 23/11/2017, and the same reads thus:-
http://www.judis.nic.in 11 “By letter dated 18/3/2010, issued by the District Collector, Kancheepuram to the Tahsildar, Sholinganallur, it is stated that the request for allotment of land comprised in S.No.6/2. Injambakkam Village, Sholinganallur Taluk, Kancheepuram District, for burying the dead bodies of Muslim people, it is requested to send a detailed report about the same.
The letter, dated 12/11/2015 written by the Revenue Divisional Officer, Tambaram, to the District Collector, Kancheepuram, it is stated that the land comprised in S.No.6/2 Injambakkam Village is a total extent of 2.20 hectares as per the village records it is stated as “Graveyeard” on the northern side of the said land, the graveyard of the Hindus and Christians and that old graveyard and new graveyard are situated and that there was no construction in the said land and it is kept as vacant land. The above graveyards ae situated within the three sides of the compound wall and the entire southern side of the said land is kept as vacant and there is a land on the south eastern side of the land in question and there are sufficient land for burying the dead bodies of the Muslim people and there are no construction, ancient symbols, public worship place. Low tension and high tension electric wires are not there. There is a small neem tree in the land in question. Therefore, there is no land separately for burying the dead bodies of the Muslim people residing in Injambakkam village, the people of the said village are going to nearby villages namely Palavakkam and Panaiyur for burying the dead bodies. The boundaries of the land in question are as follows:-
North by vacant poramboke land of graveyard South by compound wall of the vacant poramboke land East by compound wall of the vacant poramboke land West by Panchayat road and overhead water tank.
Further, for the allotment of the land in question for burying the dead bodies of the Islamic people, it was http://www.judis.nic.in 12 inspected by the Deputy Inspector of Sholinganallur Taluk and it was found by him that the land comprised in S.No.6/2 measuring 1.955 hectares as graveyard, S.No.6/4 measuring an extent of 0.24.5 hectares are there for burying the dead bodies of the Islamic people (Total extent 1.95.5 + 0.24.5 = 2.200 hectares) for fixing the land value, the nearby land was selected and as per the Document No.2768/15 the sale deed dated 9/4/2015 and as per the said document, it was found that value of the land is 5,690 per sq.feet and that the market value of the land in question comes to 0.24.5 hectares x 2.47 = 60.5 cent 436 = 26378 x 5690 = Rs.15,00,90,820/- and as per the guidelines value in respect of the land surrounding the land in question is Rs.2,500/- and therefore, the market value of Rs.5,690/- shall be taken into account for fixing the land value.

By the letter 8/2/2016 written by the District revenue Officer, Kancheepuram to the Tahsildar, Sholinganallur Taluk, it is requested to enclose the copy of document bearing No.2768/2015 dated 9/4/2015 and the copy of the resolution passed by the Corporation.

In the letter dated 5/5/2017, sent by the Tahsildar, Sholinganallur to the Zonal Officer, Zone No.15, it is stated that the land comprised in S.No.6/2, Injabakkam village, Sholinganallur Taluk, Kancheepuram District measuring an extent of 0.24.5 hectares for the allotment of land for the Muslim Jamathars for burying the dead bodies of the people and to take further action for setting up burial ground in respect of the land, it is requested to send the copy of the resolution passed by the Greater Corporation of Chennai.

In the proceedings dated 18/9/2017 by the Deputy Commissioner, Southern Zone, it is stated that the land comprised in S.No.6/2, Injambakkam Vilalge, Sholinganallur Taluk, Kancheepuram District, the total extent of 2.20 hectares and out of the total extent of 2.20 hectares, the land measuring 1.95.5 hectares of land can be used for the graveyard of Hindu and Muslim people and the remaining extent of 0.24.5 hectares (40 metres wide and 61.40 metre length) can be allotted to the Muslim people for burying the dead bodies and the common passage leading from Harichandra Salai (41 metres x 8.5 metres) can be used by the Muslim people, and the measurement of the land is http://www.judis.nic.in 13 correct.

Therefore, the inspection report of the above said Special Tahsildar, Zone 15, Ward No.196 the land comprised in Sno.6/2 Injambakkam Vilalge, Sholinganallur Taluk, Kancheepuram District, the total extent of 2.20 hectares and out of the total extent of 2.20 hectares, the land measuring 1.95.5 hectares of land can be used for the graveyard of Hindu and Muslim people and the remaining extent of 0.24.5 hectares (40 metres wide and 61.40 metres length) can be alloted to the Muslim people for burying the dead bodies and the common passage leading from Harichandra Salai (41 metres x 8.5 metres) can be used by the Muslim people and to inform about the No objection issued by the Greater Chennai Corporation to the District Collector, Kancheepuram and the permission granted by the Special Officer, Standing Committee (Tax levy and Finance) the proceedings of the Commissioner dated 23/11/2017 is read as follows:-

“To inform the District Collector, Kancheepuram, permission is granted to the Special Officer (Standing Committee (Tax Levy and Finance).”

8. Thereafter, Zonal Officer, Zone 15, Greater Chennai Corporation, Chennai, has written a letter, in Ma.Aa.No.15 RC No.44/2202/2017, dated 14/12/2017, addressed to the Tahsildar Sholinganallur Taluk, Sholinganallur, Chennai, stating that a Resolution has been passed and he has sent a copy of the Resolution to the Tahsildar, Sholinganallur Taluk, Sholinganallur, Chennai. Letter, dated 14/12/2017, reads thus:-

“As per the Special Officer's Resolution No.757/2017, http://www.judis.nic.in 14 dated 23/11/2017, cited in the second reference above, permission has been granted by the Special Officer for the use of the land in Zone No.15, Ward No.15, Kancheepuram District, Sholinganalllur Taluk, Injambakkam Village, comprised in S.No.6/2 measuring a total extent of 2.20 hectares and out of the total extent of 2.20 hectares the land measuring 1.95.5 hectares of land can be used for the graveyard of Hindu and Muslim people and the remaining extent of 0.24.5 hectares (40 meters wide and 61.40 metres length) can be allotted to the Muslim people for burying the dead bodies and the common passage leading from Harichandra Salai (41 metres x 8.5 metres) can be used by the Muslim people, permission has been granted by the Special Officer's Resolution to issue No Objection of the Greater Chennai Corporation has been sent to District Collector, Kancheepuram.
In furtherance of the same, the copy of the resolution passed by the Greater Chennai Corporation of Chennai for setting up Muslim graveyard in the land comprised in S.No.6/2 is hereby enclosed.”

9. After considering the request, the District Collector, Kancheepuram, vide, proceedings in R.C.No.7539/2010/N2, dated 1/7/2018, issued orders, permitting use of 0.24.5 hectares out of the total area of 2.20.0 hectares of land, in S.No.6/2 Injambakkam Village, Sholinganallur Taluk, Kancheepuram District. Proceedings dated http://www.judis.nic.in 15 1/7/2018, reads as under:-

Ref: 1. Letter in Na.Ka.6684/200/As1, dated 31/8/2015 of the Tahsildar, Sholinganallur.

2. Letter in Na.Ka.No.3152/2015 A dated 12/11/2015 of Revenue Divisional Officer, Tambaram.

3. Letter of this office in Na.Ka.No.7539/2010/AN2 dated 28/3/2017 and last reminder dated 7/12/2017

4. Letter in Na.Ka.No.6684/2009 Aa2 dated 21/12/2017 of the Tahsildar, Sholinganallur.

“Request for allotment of land comprised in S.No.6/2 Graveyard poramboke land situated in Injambakkam village, Sholinganallur Taluk, Kancheepuram District, measuring an extent of 0.24.5 hectares for burial of dead bodies by the Injambakkam Muslim Jamath, the reports of the Revenue Divisional officer, Tambaram and the Tahsildar, Sholinganallur in the references cited 1 and 2 above were considered.

2. As per the village records, the land comprised in S.No.6/2 total extent 2.20.0 hectares situated in Injambakkam Village, Sholinganallur Taluk, Kancheepuram District, it has been notified as graveyard.

Application has been submitted to the District Collector by the Muslim Jamathars of Injambakkam, on 28/8/2017 to allot the above said land for the purpose of burying the dead bodies of Muslim people. In the said application the petitioner has submitted that he is residing in the said village for the past 20 years and that 250 Muslim http://www.judis.nic.in 16 families are residing and at present the dead bodies are being buried in the Kabarasthan situated in Palavakkam and in that people residing at Palavakkam are objecting the burial of the Muslim people of his village and therefore, they are burying the dead bodies in the Injambakkam village burial ground and therefore, for the said purpose land may be allotted for burying the dead bodies of Muslim people.

The enquiry was conducted on the said application and on perusal of the report submitted by the Revenue Divisional Officer, Tambaram in the reference second cited above has stated that on the Northern side of the above said land the burial ground of Hindus and Christians are situated along with the old crematorium and new crematorium and except this, there are no other structures in the said burial ground and other places are kept vacant surrounded by compound wall.

Further, the south eastern side of the land in question is completely vacant and there are sufficient land for burying the dead bodies of the Muslim and there are no construction, ancient symbols, public worship place. Low tension and high tension electric wires are not there. There is a small neem tree in the land in question. Therefore, there is no land separately for burying the dead bodies of the Injambakkam Muslim the people of the said village are going to nearby villages namely Palavakkam and Panaiyur for burying the dead bodies. The boundaries of the land in question are as follows:-

North by vacant poramboke land of graveyard South by compound wall of the vacant poramboke land East by compound wall of the vacant poramboke land West by Panchayat road and overhead watertank.

6. On the enquiry conducted by the Deputy Tahsildar, Sholinganalllur, it is found that the land in question may be allotted for the Muslim people for burying of the dead bodies as follows:

It was suggested in the report submitted by the Revenue Divisional Officer, Tambaram that the land comprised in S.No.6/2 measuring an extent of 195.5 hectares as graveyard, http://www.judis.nic.in 17 land in S.No.6/4 measuring 0.24.5 hectares is allotted for the Muslim people for burying the dead bodies and the said suggestion was objected by the village people and therefore, a Peace Committee may be convened and through this, the issue may be sorted out.
In this regard, the Special officer Standing Committee, (Levy of tax and finance) Corporation of Chennai has passed a Resolution No.757/2017 dated 23/11/2017 has given permission for allotment of the land in question.
Further in the year 2015, he has deposed about the advertisement for the objections made by the then Tambaram Taluk Pallikaranai Revenue Inspector. Further, in this regard, the then Tambaram Taluk, Injambakkam Village Administrative Officer has not objected for the said advertisement.

7. By letter dated 26/8/2015, the Tahsildar, Sholinganallur and by letter, dated 9/1/2018 by the District Revenue Officer was re-inspected the land in question with regard to the allotment of burial ground for the Muslim Community people in respect of the land comprised in S.No.6/2 measuring 0.24.5 hectares out of the total extent of 2.20.0 hectares.

It was recommended by the Tahsildar, Sholinganallur in the fourth reference cited letter to allot the land measuring 0.24.5 hectares out of the total extent of 2.20.0 hectares of land comprised in S.No.6/2 Injambakkam village, Sholinganallur Taluk and to use the said land for burying the dead bodies of the Muslim community people.

On the side of the applicant, an application was submitted to use the land and allot the land in the above said Village namely S.No.6/2 graveyard poramboke land measuring 0.24.5 ares out of total extent of 2.20.0 hectares as burial ground to the Muslim community people. Further, in Injambakkam village, there are about 250 Muslim families are residing and therefore, for burying the dead people, they have to go to Palavakkam Vilalge which is a far away place, further the graveyard situated in Palavakkam village is a small place and for burying the dead people in the land in question they have obtained No Objection from the Greater Chennai Corporation to inform the same to the District Collector, Kancheepuram and to that effect, a Resolution was passed in Resolution No.757/2017 dated 23/11/2017 was received by this http://www.judis.nic.in 18 office.

Therefore, considering the necessity of the Muslim people, residing in Injambakkam village and on the recommendation of the Tahsildar, Sholinganallur and on the basis of the Resolution No.757/2017 dated 23/11/2017 passed by the Greater Chennai Corporation, the objections of the general pubic need not be taken into consideration and therefore it is hereby permitted to the Corporation of Chennai to make Muslim community graveyard in respect of the land comprised in S.No.6/2 measuring an extent of 0.24.5 hectares out of the total extent of 2.20.0 hectares, as per the sketch annexed herewith. Copy of the sketch is enclosed.”

Though the learned counsel for the petitioner assailed the correctness of the order impugned, perusal of the material on record shows that no sooner an application was made by the Muslim Jamath of Injambakkam Village, on 28/2/2018, for allotment of a plot for the purpose of burying dead bodies of Muslim. The authorities have considered the request, an enquiry has been conducted, on the application, after following the procedure and after arriving at a categorical finding, there is need for a burial ground, District Collector, Kancheepuram District, first respondent has passed a well considered and reasoned order.

11. Impugned order cannot be set aside for any one of the grounds raised. Though the learned counsel for the petitioner submitted that there is a variance in observing as to whether there was objections from Hindus or not and further contended that the Peace Committee Meeting has failed, keeping in mind, that communal and religious harmony should be maintained, for peaceful living of all Sections of the society, District Administration is directed to take adequate measures to ensure the same. Before we part with the case, a reminder of what we have resolved.

In the result, the writ petition, filed to quash the order of the first respondent, dated 1/7/2018, allotting 0.24.5 hectares (60.5cents) for the Muslim burial ground, out of the total are of 2.20.0 hectares in survey number 6/2 Injambakkam Village, is dismissed. No costs. Consequently, the connected Miscellaneous Petitions are closed.
