CORAM: HON'BLE MR.JUSTICE RAKESH KUMAR JAIN Present: Mr.M.L.Sarin,Sr.Advocate, with Ms.Hemani Sarin,Advocate,for the petitioners Mr.A.C.Jain,Advocate,for the respondent. Rakesh Kumar Jain,J: (Oral) Both the parties are ad idem that the orders passed by the Courts below may be set aside and the matter be remanded back to the learned Rent Controller, Ambala City, to decide the eviction petition afresh on the basis of existing evidence led before the Rent Controller, Learned counsel for the landlord has further submitted that the eviction petition was filed in the year 1999 on the ground of personal necessity, thus an appropriate direction may be given to the learned Rent Controller to decide the eviction petition expeditiously as early as possible, preferably within a period of one month from the date of receipt of record. I order accordingly.

It is needless to say that since the learned Rent Controller is to decide the lis between the parties afresh, therefore, all the CR No.2589 of 2010 (O&M) -2- points shall remain open to be argued before him.

The parties are directed to appear before the learned Rent Controller, Ambala City on 08.4.2011.

The Registry is directed to send the record of the Court below before the date given by this Court for appearance of the parties.

It is made clear that after the order is passed by the learned Rent Controller, the learned Appellate Authority shall also decide the appeal, if any filed, within six months after excluding the period for filing of the appeal.

With the aforesaid direction, this revision petition stands disposed of.
