By order dated 16/04/2026, we had directed the parties to file a praecipe before the Hon'ble Chief Justice seeking directions that the present Division Bench hear the present First Appeals along with Misc. Civil Application No.1450 of 2025 (F) in Civil Revision Applications bearing No.1267 of 2025 (F), Misc. Civil Application No.1452 of 2025 (F) in Civil Revision Application No.1451 of 2025 (F), and Misc. Civil Application No.1855 of 2025 (F) in Civil Revision Application No.1854 of 2025 (F), which are presently before the learned Single Judge of this Court. This is in view of the fact that Page 4 of 6 21st April, 2026 ::: Uploaded on - 22/04/2026 ::: Downloaded on - 22/04/2026 23:26:43 ::: 41 FA 9 2024 conflicting judgments may be passed on a point of law which is identical in all these matters.
2. It is brought to our notice that, by Circular dated 26/04/2022 issued by the Registrar (Judicial-I) at the Principal Seat of this Court, and with reference to the order dated 10/07/2019 of the Hon'ble Chief Justice delegating administrative powers, the power to constitute a Special Bench for clubbing/tagging/detagging of matters on praecipes moved by Advocates and parties has been delegated to the seniormost Judge at the Benches at Nagpur, Aurangabad, and at the High Court of Bombay at Goa.
3. We, therefore, consider it appropriate that the Misc. Civil Application No.1450 of 2025 (F) in Civil Revision Applications bearing No.1267 of 2025 (F), Misc. Civil Application No.1452 of 2025 (F) in Civil Revision Application No.1451 of 2025 (F), and Misc. Civil Application No.1855 of 2025 (F) in Civil Revision Application No.1854 of 2025 (F), which are before the learned Single Judge, be heard along with these First Appeals.
4. Accordingly, the Registry shall place the aforementioned three Revision Applications, which shall be tagged to the present First Appeals.
5. The Petitioners in the aforementioned three Revision Page 5 of 6 21st April, 2026 ::: Uploaded on - 22/04/2026 ::: Downloaded on - 22/04/2026 23:26:43 ::: 41 FA 9 2024 Applications shall supply an additional copy to the Registry to facilitate this process.
6. Considering that the suits from which the aforesaid three Revision Applications have arisen are now due to be heard by the District Court at Merces, Tiswadi, Goa, on different dates, we deem it appropriate to direct the District Judges dealing with these suits to defer the hearing of those suits to any date after 25/06/2026.
7. List all these matters for hearing on 16/06/2026.
