Section 5(2) in Oil Industry Development Board Employees (Death-cum-Retirement) Gratuity Rules, 1983

(2)In the case of death, the amount of gratuity will be calculated as provided in sub-rule (1) or as mentioned below whichever is more:-
[Lights of Service [Substituted by Notification No. G.S.R. 398(E), dated 30.3.1989 (w.e.f. 26.12.1983).] Rate of Gratuity
(i) Less than one years. 2 times of emoluments
(ii) One year or more but less than 5 years. 6 times of emoluments
(iii) 5 year or more but less than 20 years. 12 times of emoluments
(iv) 20 Years or more Half emoluments for every completed six monthly periodof qualifying service service subject to a maximum of 33 times of emolumentsprovided that the amount of Death Gratuity shall in no case exceed[such amount as may be notified by the Central Government from time to time] [Substituted 'one lakh rupees' by Notification No. G.S.R. 1026(E), dated 11.10.2018 (w.e.f. 26.12.1983).]]
