Petitioner is aggrieved of the order dated 15.05.2019 (Annexure P-5) to the extent while serving as a Granthi under the Shiromani Gurudwara Parbandhank Committee, he has been transferred from Gurudwara Pipli Sahib to Gurudwara Guru Nanak Ghat, Ujjain (Madhya Pardesh).

The sole contention raised by counsel is that the petitioner is a permanent resident of the State of Punjab and by virtue of the impugned order, he would be inconvenienced. It is argued that even on an earlier occasion, the petitioner had been transferred from Amritsar to Bulandshehar (U.P.) and upon filing CWP-17470-2018, counsel for SGPC had furnished assurance that the transfer aspect would be re-looked sympathetically. It is contended that in pursuance to such statement made before this Court, petitioner had been adjusted in the State of Punjab itself.

Counsel for the petitioner has been heard at length and pleadings on record have been perused.

It is not the case made on behalf of the petitioner that he holds a post which is not transferable. A specific query had been put to counsel as to 1 of 2 ::: Downloaded on - 20-10-2019 01:43:32 ::: CWP-21331-2019 (O&M) -2- whether there is any provision/Rule governing the condition of service of the petitioner and as per which he cannot be transferred out of the State of Punjab. No such provision has been brought to the notice of this Court during the course of hearing. None has been pleaded or placed on record.

Apparently, petitioner being an employee of the SGPC is open to be transferred to any other Gurudwara being managed by SGPC.

No ground for interference is made out.

Petition is dismissed.
