Order 06/07/2022 This anticipatory bail application under Section 438 Cr.P.C. has been filed by the petitioner apprehending his arrest in connection with FIR No.595/2019, Police Station Anupgarh, District Sriganganagar for the offences under Sections 420, 467, 468, 471, 120B IPC.
Learned counsel for the petitioner submits that previously, 2-3 different investigating officers after investigation, filed FR in this case, however later on, the complainant managed to get the case transferred to a different police station and now the police wants to arrest the petitioner in this false case after four years. He further argued that Yash (son of the deceased) has filed an affidavit in which, it has been mentioned that his father had entered into an agreement to sell the tractor in question to the present petitioner. In these circumstances, the benefit of anticipatory bail should be granted to the accused-petitioner. (Downloaded on 11/07/2022 at 08:25:13 PM)

Heard learned counsel for the parties.
I have considered the arguments advanced before me and gone through the material available on record.
After going through the case diary, it is revealed that the police had obtained relevant record from the transport department and prima facie involvement of petitioner has been found to be proved. Since the investigation is still going on, in these circumstances, it is not a fit case for grant of pre-arrest bail to the petitioner. Hence, the present anticipatory bail application filed by the accused-petitioner under Section 438 Cr.P.C. is hereby dismissed.
