                                      ORDER

                                             The Commission has received a  complaint   petition;  dated   29   July   2013   (Dy.   No.  155493/2013) from Shri Sudesh Kumar Goyal, Delhi  stating  that   he   has   not   received   any   information   from   the  concerned PIO in respect of his RTI application dated 01  July 2013 submitted to the PIO/SDM  (Chanakya Puri), New  Delhi   as   the   concerned   PIO   just   informed   him   to   make  inspection   of   record   and   take   copies   thereof,   without  even making any reference for sought information.  A copy   of the complaint and RTI application are enclosed.

2. In exercise of the powers vested under Section 18(1) of  the   Right   to   Information   (RTI)   Act,   the   Commission  directs   the   Appellate   Authority   to   enquire   into   the  allegations   made   by   the   Complainant   and   to   pass   an  appropriate   order   with   a   view   to   ensuring   that   the  desired   information   is   provided   to   the   Complainant,   at  the earliest.

3. The   Appellate   Authority   is   also   directed   to   obtain   the  explanation of the PIO in writing for not furnishing the  information   sought   by   the   complainant   which   is   a  statutory   requirement   and   to   forward   the   same   to   the  Commission   along   with   his   comments   within   3   weeks   of  receipt   of   the   Order   to   decide   on   the   imposition   of  penalty   on   the   concerned   persons   in   terms   of   Section  20(1) of the Right to Information (RTI) Act.

4. In case the Complainant is not satisfied with the orders  of the Appellate Authority, he is free to approach this  Commission in second appeal.

5. The Complaint is disposed of with the above directions.
