ORAL ORDER
2 09-11-2015Heard Mr. Baxi S.R.P. Sinha for the petitioner, the Counsel for the informant and the APP for the State.
Petitioner is grandfather of the husband of the deceased. He along with other family members is facing prosecution under Section 304B/34 of the Indian Penal Code vide Manjhagarh P.S. Case No 95 of 2015.
Allegation is that within few months of the marriage, the victim was done to death in the matrimonial home. It has been submitted that the petitioner is more than 75 years of age and is a very old person and pace maker has been implanted on him. Presumably, an old person is not heard in the family.
Considering the age of the petitioner, in the event of arrest or surrender in the Court below within four weeks, he is directed to be released on anticipatory bail on furnishing bail bond Patna High Court Cr.Misc. No.50352 of 2015 (2) dt.09-11-2015 2/2 of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Gopalganj in Manjhagarh P.S. Case No. 95 of 2015 subject to the condition as laid down under Section 438(2) of the Cr.P.C. with the further following conditions:
(i) One of the bailers shall be the own/close family members of the petitioner.
(ii) In case of framing of charge, the petitioner shall appear in person on each and every date fixed in the Court below. In case of default in doing so on two consecutive occasions without any cogent/satisfactory reason, the Trial Court shall have liberty to cancel the bail bond of the petitioner and secure his arrest in accordance with law.
