THE HIGH COURT OF MADHYA PRADESH MCRC-8806-2018 (SAMVART SINGH Vs THE STATE OF MADHYA PRADESH) 5 Jabalpur, Dated : 09-04-2018 Neither the counsel for the applicant nor the counsel for the State has appeared on account of a call given by the State Bar Council for abstaining from work.
Mr.Brijendra Singh Yadav, has appeared as the Objector in sh person. He is the brother of the deceased. This application is the e second application for grant of anticipatory bail. The first application ad was dismissed vide order dated 09.02.2018 passed in Pr M.Cr.C.No.20628/2018 by an elaborate considered order. However, in the interest of justice, this Court would not like to pass an adverse a hy order in absence of the learned counsel for the applicant.
Under the circumstances, it considers it fit to record the ad statement of the Objector:-
M "The Objector has stated that the applicant is one of the person who was involved in the murder of his brother. He says of that this has been stated by the three witnesses who are Virendra rt Yadav @ Tinku, Rahul Yadav and Trilok Yadav @ Nitin Yadav. ou The incident is stated to have taken place on 27.09.2017 at 9:00 PM."
C The applicant has sought anticipatory bail on the ground of alibi h that he was not in Jabalpur on the date on which the incident happened ig and that he had travelled to Barka Kana on 26.09.2017 by Shaktipunj H Express. It it pertinent to mention here that the plea of alibi has already been considered in the earlier application which was dismissed on 09.02.2018.
Under the circumstances, list this case on 16.04.2018.
