Heard learned counsels for the petitioner and the State.

The petitioner is apprehending arrest in Nawada (Kadirganj) P.S. Case No. 112 of 2012 registered for the offences punishable under Sections 201, 302 and 376G/34 of the Indian Penal Code pending in the court of learned Chief Judicial Magistrate, Nawada.

It is alleged that the minor niece of the informant went missing on 09.03.2012, subsequently naked dead body was recovered when it was suspected that the petitioner and others killed the niece of the informant after establishing forceful physical relationship since there was some dispute between the informant and the petitioner and others 11/2 years prior to the occurrence.

It is submitted by learned counsel for the petitioner that only on suspicion, the accusation has been levelled and there is no eye-witness to the occurrence.

Let the learned court below consider the regular bail of the petitioner if the petitioner surrenders within a period of six weeks.

With the above observation, this application is, accordingly, disposed off.
