1. One of the issues which would arise for consideration would be whether the learned Single Judge was justified in what is termed to be a modification of the original Award. We bear in mind the reference which has been made by the Supreme Court to a larger Bench for considering the issues which arise from the judgment in NHAI vs. M. Hakeem [(2021) 9 SCC 1]. That reference was made in Gayatri Balasamy vs. M/s ISG Novasoft Technologies Limited [SLP (C) No. 15336-15337/2021] and is yet to be answered.
2. Awaiting the outcome of that reference, let this appeal be re- notified for 09.01.2025.
