FACTS

Heard today dated 1.10.2012. Appellant present. The Centre is represented by Shri N. Subramanian, (CPIO); Shri K.V.S. Kameswara Rao (former CPIO) and Shri L. Bhattacharjee.

2. The matter, in short, is that the appellant is an Information Scientist in the Centre. Vide RTI application dated 2.8.2011, he had sought information on 07 paras about the payment of LTC claims and medical claims to certain employees of the Centre. Shri Kameswara Rao, the then CPIO, however, had refused to disclose this information u/s 8 (1) (j) vide letter dated 5.9.2011. On appeal, the AA in order dated 25.10.2011, however, had set aside the CPIO's order and directed disclosure of requested information.

3. During the hearing, it transpires that information on all paras has already been provided to the appellant except for para 05. In para 05, the appellant had sought information relating to medical claim of Shri Kannan Kasturi who has since left the organisation.

4. In my opinion, the appellant is entitled to inspect the records relating to financial claims of Shri Kannan but he is not entitled to take photocopies of the medical prescriptions. In the premises, it is ordered that the appellant may be given inspection of the records relating to Shri Kannan Kasturi.

5. The matter, however, does not end here. It is the appellant's contention that even though the AA had passed orders for disclosure of requested information on 25.10.2011, Shri Kameswara Rao deliberately delayed the disclosure of information till April, 2012, thereby enabling Shri Kannan Kasturi to leave the organisation. Shri Rao admits that there has been delay and regrets the same. Even so, he is cautioned to be careful in future.
