% 15.02.2017 C.M. No. 1318/2017 (for condonation of delay of 71 days in re-filing the appeal)

1. As per the office report, the respondent as also the counsel appearing for him in the trial court have been duly served.

2. Appearance is entered by learned counsel for the respondent who states that she does not wish to file a reply to the present application.

3. For the reasons stated in the application, the same is allowed. The delay of 71 days in re-filing the appeal is condoned.

4. The application is disposed of.

RFA 41/2017 and C.M. No. 1316/2017 (stay)

1. Learned counsel for the respondent states that she has received a complete set of the paper book and does not have any objection to the present appeal being disposed of by the same order as passed in the other RFA 41/2017 Page 1 of 2 connected appeals filed by the appellant/EDMC, that were disposed of by a consent order dated 01.12.2016 passed in RFA 192/2016, being the lead case. She however states that the appellant be called upon to indicate the exact amount that would be payable to the respondent under the decree and the estimated date of payment.

2. Ms. Pushkarna, learned counsel for the appellant hands over a brief compilation wherein, the details of the work order division, decretal amount the position of the respondent in the seniority list and the estimated date of payment have been reflected. The same is taken on record.

3. As per the aforesaid compilation, the appellant has mentioned the decretal amount as Rs.6,32,572/- and given an estimated date of payment as April, 2017. The same is acceptable to the counsel for the respondent.

4. Accordingly, the present appeal is disposed of along with the pending application in terms of the order dated 01.12.2016 passed in RFA 192/2016 and the other connected appeals filed by EDMC.
