The present petition under Article 227 of the Constitution of India has been preferred to assail the order dated 02.05.2024 passed by the learned District Judge (Commercial Court) South East, Saket Court (hereinafter referred as ‗ Trial Court ') in Case No. CS No. Comm. 447/21 titled as ―Aviva Life Insurance India Ltd. versus Teleperformance Global Services Pvt Ltd.‖, whereby the written statement of the petitioner has been taken on record along with the affidavit of admission/denial which has been subsequently filed beyond the stipulated period of time.
