In R.F.A. Nos. 2347, 2361, 2381, 2407 of 1994, 804, 1068, 1070, 1074, 1078, 1079, 1081, 1083, 1088, 1091, 1153, 1161, 1164, 1610, 1820, 1826, 1827, 2196 of 1996, 565, 566, 568, 569, 570 and 3799 of 1999 filed by the State, the land owners have also filed cross-objections seeking enhancement of compensation.

The facts have been extracted from R.F.A. No. 2095 of 1994. Briefly, the facts are that land in question situated in villages Patti Insar and Patti Magdum Jadgan, Tehsil and District Panipat was acquired vide notification dated 23.2.1989 issued under Section 4 of the Land Acquisition Act, 1894 (for short, `the Act') for the development and utilization of land as residential and commercial area of Sector 17, Panipat. The same was followed by notification dated 22.2.1990 issued under Section 6 of the Act. The Land Acquisition Collector (for short, `the Collector') gave award of Rs. 2,00,000/- per acre for chahi and nehri land and Rs. 1,50,000/- per acre for gair mumkin land. Aggrieved against the same, the land owners filed objections which were referred to the learned Court below, who keeping in view the material placed on record by the parties, awarded Rs. 81/- per square yard as compensation for the acquired land.

Learned counsel for the land owners submitted that the claim made by them in the present set of appeals is squarely covered by a judgment of this Court passed in R.F.A. No.1379 of 1994 -Nand Lal and others v. State of Haryana and another, decided on 29.11.2006, where value of the acquired land was assessed at Rs. 139/- per square yard.

Learned Advocate General, Haryana appearing for the State very fairly conceded factual situation, as stated by learned counsel for the land owners.

Accordingly, for the reasons stated in Nand Lal's case (supra), the appeals and cross-objections filed by the land owners are accepted in terms of the said judgment, whereas the appeals filed by the State are dismissed.
