ORDER
02. 25.9.2020 In the wake of the pandemic Covid-19, the case is taken up through V.C. In this writ petition, the petitioners have prayed to issue a writ in the nature of mandamus directing the opposite parties to extend the benefits in terms of the judgment of this Court in the case of Dhananjay Charan Dev. State of Orissa passed in WPC No.31679 of 2011 disposed of on 5.3.2020.
Mr. S. Patra, learned counsel appearing on behalf of Mr. S. Mishra, learned counsel for the petitioners submits that the petitioners are some of those 619 eligible teachers working as Sikhya Sahayak and their services should have been regularized taking into consideration their initial date of appointment.
Mr. Satpathy, learned Standing Counsel for School and Mass Education Department submits that nothing has been placed on record to indicate whether the petitioners belong to those 619 eligible teachers and were working as Sikhya Sahayak or not. In any case, if the petitioners belong to those 2 619 eligible teachers, as per the judgment under Annexure-2, their case shall be considered in accordance with law.
Considering the aforesaid submissions, this writ petition is disposed of granting liberty to the petitioners to file a fresh representation before the authority concerned within one month hence ventilating all the grievances raised in this writ petition. If such a representation is filed within the period stipulated, the same shall be considered by the authority concerned within two months thereafter taking into consideration the law laid down by this in the aforesaid decision of this Court.
The parties may utilize the copy of this order as per the High Court's Notice No.4587 dated 25.03.2020.
