UPON hearing the counsel the Court made the following
O R D E R
Having heard learned counsel for the petitioner, and having perused the impugned order, we find no justification Signature Not Verified Digitally signed by whatsoever to interfere with the impugned order in exercise of SARITA PUROHIT Date: 2017.12.06 10:19:45 IST Reason: our jurisdiction under Article 136 of the Constitution of India. In the peculiar facts and circumstances of this case, leaving 2 the question of law open, we dismiss this petition.
Keeping in view the aforesaid facts and circumstances of the case, we allow the petitioner to remain in occupation of the premises for a period of three months from today, subject to the petitioner's filing the usual undertaking in this Court within two weeks from today, including an undertaking to handover vacant possession of the premises in question, to the respondent-landlord, and not to create any third party rights during the interregnum.
