8 04-04-2016The challenge in the Letters Patent Appeal No. 1576 of 2014 is to an order passed by the learned Single Bench of this Court on 22nd of July, 2014 in C.W.J.C. No. 13746 of 2013, whereby certificate proceeding for recovery of alleged public demand was set aside. The other appeals arise out of orders passed in other writ applications following the said order either on the same day and on the subsequent dates.
Though, the respondent in the LPA No. 1576 of 2014, the writ petitioner, stands served and is represented but there is no representation on behalf of the other writ petitioners. There are large number of cases which are pending and fixed today. To give an opportunity of hearing to all the affected respondents and to adjudicate questions of law at an early date, we deem it appropriate that a public notice be published in two leading newspapers, i.e. Hindustan Times (English) and Dainik Jagran (Hindi), both Patna Edition apart from causing service of the notices on the Counsel who represented the respondents before the Learned Single Judge. The public notice shall give the name of the writ petitioners and the Appeals with further stipulation that any of the respondents in the Letters Patent Appeals can obtain copy of the memorandum of appeal from the counsel for the appellants.
Let public notice be published at the costs of the Appellants in the aforementioned two newspapers on or before 18th of April, 2016 with stipulation Patna High Court LPA No.1576 of 2014 (8) dt.04-04-2016 9 of 9 that the cases will be taken up for final hearing at the admission stage itself on 2 nd of May, 2016.
List these appeals on 2nd of May, 2016 as the first case under the heading "For Admission".
