1. The present petition has been filed alleging willful disobedience of the Judgment dated 03rd August, 2023 passed in W.P.(C) 123/2018, wherein, following directions were passed:

105. In view of above discussion, the respondents cannot escape their accountability with impunity as such conduct calls for strict action. The interest of justice would be met if we compensate the petitioner herein for the suffering anxiety and mental agony; monetary expenditure incurred and energy spent to get his due promotion and consequential benefits thereto after a long battle of litigation, which he was otherwise entitled to.
106. Accordingly, we direct the respondents to pay the costs for an amount of Rs.5,00,000/- (Rupees Five Lakhs only) in favour of the petitioner within four weeks of passing of this judgment. However, the Department should not be made to suffer for the deliberate dereliction of duty by an Officer. Therefore, the costs shall be paid by the This is a digitally signed order.

2. Today, Mr. Ram Niwas, Subedar, appears on behalf of the respondents and submits that payments which are due and payable to the petitioner, have already been processed. He further submits that order for release of payments to the petitioner has also been published on 10th February, 2024. He has handed over documents to this Court in that regard, which, are taken on record.

3. Learned counsel for petitioner has handed over a copy of the letter dated 18th March, 2024, wherein, certain documents have been sought by the respondents for the purposes of release of arrears to the petitioner. The said letter is taken on record.

4. The official appearing on behalf of the respondents submits that payments of the petitioner are under process, and that after submission of the required documents, the requisite payments shall be released to the petitioner, within a period of eight weeks from today.

5. Learned counsel for petitioner submits that if that is the case, then the petitioner is satisfied.

6. Accordingly, the present petition is disposed of, as having been satisfied. However, in case the petitioner is still aggrieved by any non- compliance, he is at liberty to revive the present petition.
