1. The issue under consideration arising out of the second appeal dated 21.01.2020 include non-receipt of the following information sought by the appellant through the RTI application dated 16.08.2019 and first appeal dated 11.09.2019:-

सूचना के अिधकार 2005 के तहत LIC Housing Finance Ltd., 3rd Floor, Korara Enclave, Near Rukanpura overbridge, Bailey Rd, Patna, Bihar 800014 के अपने लोन खाता *********222, *********313 & *********676 से स बि धत िन जानकारी दी जाए :-

(i) ाथ खाता *********222, *********313 & *********676 का दनांक 09 दस बर 2017 तक के outstanding amount क सूचना के अिधकार 2005 के तहत िन प मद S. No. LIC Housing, Patna Loan Account No. Outstanding account as on Page 1 of 4 09.12.2017 1 2 3

(ii) सूचना के अिधकार के तहत 2005 के तहत ाथ को सूचना द जाए क HDFC Ltd Patna ारा LIC Housing Finance Ltd., 3rd Floor, Korara Enclave, Near Rukanpura overbridge, Bailey Rd, Patna, Bihar 800014 म वयं के लोन खाता शाखा म ाथ एवं HDFC Ltd, Patna ारा खाता सं या *********222, *********313 & *********676 म राशी 17,53,970/- पये, 4,10,697/- पये, 9,80,510/- पये एवं 808/- पये के सभी चेक कस दनांक को जमा क गई ।

(iii) सूचना के अिधकार के तहत 2005 के तहत ाथ को सूचना द जाए क HDFC Ltd Patna ारा LIC Housing Finance Ltd., 3rd Floor, Korara Enclave, Near Rukanpura overbridge, Bailey Rd, Patna, Bihar 800014 म वयं के लोन खाता शाखा म ाथ एवं HDFC Ltd, Patna ारा खाता सं या *********222, *********313 & *********676 म राशी 17,53,970/- पये, 4,10,697/- पये, 9,80,510/- पये एवं 808/- पये के सभी चेक कस दनांक को Accounting क गई ।

(iv) य द उपरो सरल ामंक 1 से 3 तक से स बंिधत जानकारी आपसे स बि धत नह है तो सूचना के अिधकार 2005 के 6(3) के तहत उपरो सरल मांक 1 से 3 तक से स बि धत सूचना भेजने हेतु कृ पया स ब धी लोक सूचना अिधकारी को भेजी जाए साथ ही इसक सूचना क ित ाथ को भेजे ।

Succinctly facts of the case are that the appellant filed an application dated 16.08.2019 under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), National Housing Bank, New Delhi, seeking aforesaid information. The CPIO vide letter dated 19.08.2019 replied to the appellant. Aggrieved by the same, the appellant filed first appeal dated 11.09.2019. The First Appellate Authority (FAA) vide order dated 30.09.2019 disposed of the first appeal.

Aggrieved by the same, the appellant filed second appeal dated 21.01.2020 before the Commission which is under consideration.

3. The appellant has filed the instant appeal dated 21.01.2020 inter alia on the grounds that reply given by the CPIO was not satisfactory. The appellant requested the Commission to direct the CPIO to provide the complete information and take necessary action as per Section 20 (1) of the RTI Act.

4. The CPIO replied vide letter dated 19.08.2019 and the same is reproduced as under:-

"वांिछत सूचना एनएचबी के पास उपल ध नह है । आवेदक इसके िलए स बि धत एच एफ सी से संपक कर सकता है ।"

The FAA vide order dated 30.09.2019 stated that the CPIO had already replied to the RTI application.

5. The appellant attended the hearing through video conference and on behalf of the respondent Shri V. Rajan, General Manager & CPIO, Ms. Reeja Jayadeesh Dy. General Manager and Shri Sanjeev Kumar Singh, Manager, National Housing Bank, Delhi attended the hearing in person.

5.1. The appellant inter alia submitted that information sought was not provided by the respondent rill the date of hearing. He further submitted that he tried to seek the information/documents from the Housing Finance Company but he did not get the information hence he filed the instant RTI application.

5.2. The respondent while defending their case inter alia submitted that they were not the custodian of the information sought therefore they expressed their inability to provide the same to the appellant.

The Commission after adverting to the facts and circumstances of the case, hearing both the parties and perusal of records, observed that the respondent was not the custodian of the information sought by the appellant and hence they expressed their inability to provide the information. Perusal of the CPIO's reply reveals that the Page 3 of 4 respondent had asked the appellant to approach the concerned Housing Finance to procure the information. There appears to be no infirmity in the reply given by the respondent. The Commission is of the view that no public purpose would be served in further prolonging the matter. Accordingly, the appeal is dismissed.

Copy of the decision be provided free of cost to the parties.
