ORAL ORDER
3 21-12-2017Heard learned counsel for the petitioner and learned APP for the State.
Petitioner is languishing in judicial custody since 30.06.2017 in connection with Khajauli P.S. Case No. 174 of 2012, G.R. No. 3123 of 2012 for offences punishable under Sections 147, 148, 149, 323, 341, 333, 337, 427, 452, 435, 436, 380, 504, 506, 120-B of the Indian Penal Code.
The prosecution case, as lodged by the Anchal Adhikari, is that several accused persons came armed with dangerous weapons, burnt the Anchal office, damaged the Government property and also looted away the properties of Anchal office.
It has been submitted by the learned counsel for the petitioner that he is innocent, not named in the First Information Report and as many as eight cases including the present one were Patna High Court Cr.M isc. No.48349 of 2017 (3) dt.21-12-2017 2/2 filed on the same day regarding the same occurrence, in which the petitioner has been falsely implicated. He submits that there was a mob attack and general and omnibus allegations have been levelled against him. He further submits that charge-sheet has already been submitted and there is no allegation of tampering of the prosecution witnesses by the petitioner.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-III, Madhubani, in connection with Khajauli P.S. Case No. 174/2012.
