ORDER 

(Per : HONOURABLE THE CHIEF JUSTICE MR. S.J.MUKHOPADHAYA) A writ petition under Article 227 of the Constitution of India was filed by the appellant challenging the judgment and order dated 26th August 2010 passed by the learned Principal Civil Judge, Kalavad below application Exh.73 in Regular Civil Suit No.106/2007, whereby the application to file written statement to the suit by the appellant was rejected.

The learned Single Judge, having refused to interfere with the said order under Article 227 of the Constitution and thereby having refused to grant relief, the present Appeal under Clause 15 of the Letters Patent has been filed.

Having heard learned counsel for the parties, we are not inclined to interfere with the matter as the Appeal under Clause 15 of the Letters Patent is not maintainable. It is accordingly dismissed. Civil Application stands disposed of.
