                                        ORDER

06. 1. Learned counsel for the Petitioner handed over the Court a copy of the representation dated 26th November, 2021 addressed by the Petitioner to the Principal Secretary, Department of Water Resources (DoWR), Government of Odisha praying that the Government should consider exempting the Petitioner from payment of penal interest so that the Petitioner would be able to repay the principal water tax dues of Rs.14.18 lakhs.

2. A copy of the said representation has been handed over to Mr. Muduli, learned Additional Government Advocate in Court today.

3. In that view of the matter, it is directed that the said representation will be examined by the Principal Secretary, DoWR and after giving a hearing to the representative of the Petitioner, a reasoned order will be passed thereon on or before 7th February, 2022 and be communicated to the Petitioner on or before 14th February, 2022. Till then the interim order passed by this Court on 4th June, 2005 will continue.

4. If the Petitioner is aggrieved by the decision of the authority concerned, it will be open to it to seek appropriate remedies. The grounds urged by the Petitioner in the present petition are left open to be urged at that stage, if required.

5. The writ petition is disposed of in the above terms.

6. An urgent certified copy of this order be issued as per rules.
