HON'BLE MR. JUSTICE INDERJEET SINGH Order 28/06/2022 Counsel for the petitioner submits that the issue involved in this writ petition has been considered by the Co-ordinate Bench of this Court at Principal Seat, Jodhpur in the matter of State of Rajasthan & Ors. Vs. Mansingh Meena (S.B. Civil Writ Petition No. 66/2022) wherein on 31.01.2022 following order was passed:-
"The defects pointed out by the office in the circumstances of the case are over-ruled.
Heard.
It is submitted that the
Rajasthan Civil Services
Appellate Tribunal was not
justified in quashing the
Condition No.1 of the order of transfer providing that in case the transferred employee is on probation, he/she shall not be relieved, while allowing the appeal filed by the respondent. In view of submissions made, issue notice. Issue notice of stay petition also. Notices are made returnable within four weeks. Notices when issued, be given 'Dasti' to the counsel for the petitioners for service upon the respondent. In the meanwhile and till further orders, effect and (Downloaded on 01/07/2022 at 09:09:12 PM) (2 of 2) [CW-6634/2022] operation of order dated 08.09.2021 (Annex.2) passed by the Tribunal shall remain stayed, in case pursuant to the order impugned the respondent has not been relieved.
Connect with SBCWP No.17295/2021."
In that view of the matter, issue notice to the respondent(s) returnable by four weeks.
Meanwhile, operation of the order dated 17.09.2021 (Annexure-2) passed by the Tribunal shall remain stayed.
List this matter after four weeks along with CW No.5751/2022.
