18-05-2026 Heard Mr. N. Jotendro, learned senior counsel assisted by Mr. A. Jankinath Sharma, learned counsel appearing for the petitioner; Mrs. L. Monomala, learned GA appearing for the respondents No. 1 to 4 and Mr. W. Darakishwor, learned senior panel counsel appearing for the respondent No. 5.

At the outset, the learned senior counsel appearing for the petitioner submitted that the Ministry of Consumer Affairs, Food & Public Distribution, Government of India, has issued a Notification dated 28-12-2021 in exercise of the power conferred by clause (zg) of sub- clause (2) of Section 101 read with Section 94 of the Consumer Protection Act, 2019, notifying the Consumer Protection (Direct Selling) Rules, 2021 (at Annexure-5). Under Rule 11 of the said Rules, it is provided that for ensuring compliance of the said rules by direct entity and direct sellers, every State Government shall set up a mechanism to monitor or supervise the activities of direct seller and direct selling entity. petition can be disposed of by directing the respondents, more particularly the respondent No. 1 to 4, to set up a mechanism to monitor or supervise the activities of direct sellers and direct selling entity as provided under Rule 11 of the Consumer Protection (Direct Selling) Rules, 2021.

In the affidavit-in-opposition filed by the State Government, it has been, inter alia, stated at para 4 that due to emergence of COVID pandemic as well as volatile situation that erupted after the violence on 3rd May, 2023 in the State of Manipur, the State Government was unable to set up a mechanism to monitor or supervise the activities of direct selling and direct selling entity.

Mrs. L. Monomala, learned GA appearing for the respondents No. 1 to 4 submitted that she may be given two weeks' time to get instruction from the authorities in this regard and to revert back to this court. The learned GA further submitted that on the basis of the instruction received by her from the State Government, the present writ petition can be disposed of on the next date.

As prayed for by the learned GA, list this case again on 28-07-2026.
