1. Pursuant to order dated 20 th May 2025, Mr. Dhruv Rohatgi, counsel for the Government of NCT of Delhi ('GNCTD') has handed over an affidavit, which was filed yesterday, but is not on record. He points out that the order has not been complied with because after scrutiny of claims of petitioners, several discrepancies were noticed in their claims. The affidavit states that there were innumerable instances where false claims were found to be submitted and, in some cases, entire 100% claim were found to be not genuine.
2. The Scrutiny Committee found the application forms as 'Not OK' on various grounds. He further submits that the budgetary allocation for FY 2025-26 for the scheme is about Rs.15 crores, while the claims presented were much more than that and there was a huge mismatch.
3. In this regard, he states that the matter is proposed to be sent for investigation and, therefore, no confirmed tabulation of the amount could also be presented, as had been directed. Relevant parts of the affidavit are extracted as under:

The said position being presented today is not appreciated by the Court for the simple reason that, previously on 20 th May 2025, it was categorically recorded that the orders of the Court would be complied with and only some verification was pending, and that the file had moved from This is a digitally signed order.

5. It was further stated that the issue shall stand concluded within six weeks and payments would be released. The Court had specifically noted in fair amount of detail, in order dated 20 th May 2025, that the verification process had been undertaken previously in three layers on different dates with the Special Secretary, Department for the Welfare of SC/ST/OBC Minorities ('DSCST'), and had not been countered at any stage by the Department, and if there was any further verification, it ought to be completed within two weeks.
6. Further, a tabulation had been directed to be filed as per paragraph 15 of order dated 20 th May 2025, in order that there would be visibility as to what is the position of each of petitioners' claim. Relevant paragraph is extracted below for ease of reference:
"15. As per the directions of this Court on 28th January 2025, petitioners need to know their entitlement to the release of the payment. In this regard, a detailed tabulation will be prepared by respondents giving the list of petitioners, the claims that they have presented, the amounts that have been released to them partially, the balance which needs to be paid, and specific timeline within the stipulated 6 weeks for the release of remaining amount.
16. The said tabulation will be prepared in the next two weeks. A copy of the same will be provided to the counsel for petitioners, Ms. Roma Bhagat who is appearing in CONT.CAS(C) 580/2025 and CONT.CAS(C) 627/2025 and Mr. Varun Thakur who This is a digitally signed order.

The concern of petitioners was also recorded by this Cou rt and flagged considering that Memorandum of Agreements (MoAs) were signed by GNCTD, services had been given by petitioners as per the Scheme, verification process and meetings had been conducted by the Special Secretary, DSCST, but still petitioners are awaiting receipt of their monies. In this regard the following paragraphs of order dated 20 th May 2025 are being extracted as under:
"17. It is reiterated that these petitioners have been awaiting their payments for the last few years and despite agreements entered into by the State, they are still knocking on the doors of this Court for their legitimate dues.
18. It is further underscored that orders by the Writ Court were passed in January and February 2025; four to five months have passed since, however, there is still no confirmation of the payment.
19. Accordingly, the timeline of six weeks is sanctimonious and will not be diluted on any account; whatever steps need to be taken by the Department, will be taken within this time period.
20. At any stage, if it is necessary for the Department, to clarify any aspect, they will contact the concerned petitioner immediately, in order that there is no gap in communication in this regard, which can be presented as a reason not to comply later.

22. Accordingly, it is a legitimate submission by counsel for petitioners that 50% of the full stipend was to be released after enrolment of the candidates and on receipt of their details in the prescribed format.
23. Despite this, most of the institutes have not even received 50% of the installment, which was to be paid initially. Counsel for the petitioners state that at least that 50% be paid immediately. However, considering the respondent's undertaking that they will pay the full balance amounts within 6 weeks, the Court is not considering the plea of 50% by the petitioners.
24. Pursuant to the previous order Mr. Praveen Kumar Chaurasia, Deputy Director, Department for the Welfare of SC/ST/OBC/Minorities is present in the Court and has been informed of the serious concern of this Court with respect to this delay. He shall be present on the next date as well and further proceedings would be initiated in the event compliance is not made."
8. Today's submission by Mr. Dhruv Rohatgi runs completely obverse and in a completely different and opposite direction to what had been submitted previously, which he states is on instructions.

In the flow of events relating to the verification process, it was noted not only by the Writ Court, which had passed the orders of which compliance is sought, but also by this Court that verification process in a prescribed format, at the behest of GNCTD, had been conducted before the Special Secretary, DSCST and hearing had also been granted by the Special This is a digitally signed order.

10. Clearly, at this stage neither a finite time for concluding the process is being provided by the GNCTD nor is there any explanation as to why a previously concluded verification process now stands up ended.
11. Issues of budgetary allocations cannot be tendered as an excuse considering that MOUs were signed by the Government which ought to be honoured. Even if there are some discrepancies, at best, the GNCTD can at Stage I, at least pay the parties of whom none or only partial discrepancies have been found, instead of collapsing the whole payment process despite the MOU, the claims pending since 2020-21, verification having been done previously, meetings having been held and the matter as told to the Court was at its tail end and final stages.
12. In these circumstances, the Special Secretary, DSCST shall remain present in the Court on the next date in order that the Court is apprised as to why compliances are held up in these matters.
