ORDER (ORAL)
Hon'ble Mr. Ashish Kalia, Member (J) By virtue of the present OA, the applicants are seeking the following relief(s):
(i) "To quash and set aside the impugned RRs dated10.05.2022 to the extent that the qualifying service for promotion from the post of Stenographer to Personal Assistant has been enhanced from 5 years to 10 years and issue appropriate directions for restoration of minimum required service of 5 years for promotion from the post of Stenographer to Personal Assistant as existed in un-amended Recruitment Rules.
(ii) To direct the respondents to insert a note in the Govt.
of NCT of Delhi Service Rules, 2022 to give effect to para 3.1.3 of DOP&T OM dated 31.12.2010 and in terms of para 6 of OM dated 20.09.2022 as well as Circular dated 03.10.2022 of Govt. of NCT of Delhi and consider the claim of applicants for promotion to the post of Personal Assistant from completion of 5 years of service with all consequential benefits including arrears of pay.
(iii) to declare the action of respondents in increasing the eligible service for promotion from the post of Stenographer to Personal Assistant from 5 years to 10 years as illegal and issue appropriate directions for reducing the minimum required service for promotion from the post of Stenographer to Personal Assistant as 5 years or less than 5 years keeping in view the nature of duties &responsibilities attached to the post of Stenographer to Personal Assistant.
(iv) to quash and set aside the impugned Clause No. 3 of Schedule-II to Recruitment Rules dated 10.05.2022 known as the Govt. of NCT of Delhi Service Rules, 2022 and issue appropriate directions to the respondents for providing suitable promotional avenues to the applicants in shortest possible time by 20 Item No. 3 O.A. (v) to allow the OA with cost.
(vi) pass any further orders as this Hon'ble Tribunal may deemed fit and proper in the facts and circumstances of the case."
2. The applicants are working as Steno Grade-III (re- designated as Stenographer). On completion of 5 years they are eligible for the post of Personal Assistant. In the meantime, rules have been amended and the residency period has been increased from 5 years to 10 years. The relevant circular is at page 159, para (3) thereof reads as under:-
"Further. information regarding status of recruitment rules received from the Departments, organizations and allied / field offices, along with a compendium of relevant guidelines instructions/ circulars (DoPT's O.Ms. dated 31.12.2010 & 31.03.2015. These compendium of relevant guidelines/ instructions circulars may not be an exclusive list and Nodal Officers of each Department, organization and allied field office as well as both Nodal Officers of AR Department shall ensure that the proposals are made in accordance. with all applicable rules. guidelines, instructions, etc. as amended from time-to-time."
3. The counsel for the respondents draws our attention to DOPT circular (page 101) para 3.13 whereof states that 21 Item No. 3 O.A. No. 3856/2022 M.A. No. 3916/2022 M.A. No. 3917/2022 the persons holding the feeder posts on regular basis on the date of notification of the revised rules, could be included in the revised rules. However, the names of applicants are not included. Being aggrieved, they have approached this Tribunal without any impugned order being passed by the respondents.
4. Two MAs have been filed by the applicants i.e. MA No. 3916/2022 seeking permission to join together in single application and MA No. 3917/2022 seeking exemption from filing legible copies of dim Annexures of handwritten and translation.
5. For the reasons given in the aforesaid MAs and keeping in view no objection from the learned counsel for the respondents, both the MAs are allowed.

7. Learned counsel, who appears on advance service on behalf of the respondents, accepts notice.
8. We are of the view that ends of justice would be duly met if the respondents are directed to re-look into the Rules, in terms with the DOPT guidelines mentioned above, 22 Item No. 3 O.A. No. 3856/2022 M.A. No. 3916/2022 M.A. No. 3917/2022 within a period of 60 days with liberty to the applicants to approach this Tribunal. We order accordingly.
9. It is made clear that we have not entered into the merits of the case.
There shall be no order as to costs.
