                               ORDER

In this petition under Section 482 of the Code of Criminal Procedure, the petitioner, who is the 18th accused in CP No.19 of 2011 on the file of the Judicial Magistrate of the First Class-II, Kochi, for offences under Sections 373, 376, 292 and 120B of the Indian Penal Code and Sections 3(1), 4(1), 5(1), 5(1)(a), 6(1)(a), 6(3)

(a) and 9(1) of ITP Act, 1956 and Section 4 of Indecent Representation of Women (Prohibition) Act, 1986, seeks an order to direct the committal court to release the petitioner on bail on the date of surrender.

2. Having heard, I find no material on record to come to a conclusion that the petitioner would not get a just and fair disposal of his application for bail before the committal court. Therefore, this petition is a misconceived one. However, this petition is disposed of with direction to the petitioner to surrender before the committal court on the next posting date or on any other day fixed by the court and apply for bail, which the court shall Crl.M.C.No.800 of 2012 2 dispose of on merits, preferably on the same day, provided due notice is given to the Assistant Public Prosecutor.
