Information Sought:
The appellant had filed an application as under:

The appellant's son Subham Maheshwari had passed his Degree of Computer & Engineering Degree B.E. (Tech) from your Institute. The entrance number is 8740. He is a very intelligent and Gold Medalist and he had won the Best Student Award also. But he has not been treated well due to non-resident of Bihar. He has been treated with partiality because he is not a resident of Bihar thus he has not been awarded with Best Student Award. And the award given to another student Sh. Ravi Sinha (Petro Dept.) who was not eligible. The appellant want to avail information regarding the basis of distribution of the Best Student Award. In this regard, the constituted committee report, the basis of marks distribution.

The PIO enclosed the reply received from the Appellant Authority, as under:
In 2006-07 session B. Tech. Degree were awarded by this University in 7 different branches: - 1. Mining Engineering, 2. Petroleum Engineering, 3. Computer Science & Engineering, 4. Electronics Engineering, 5. Mechanical Engineering, 6. Mineral Engineering and 7. Mining Engineering.
The students getting highest OGPA in each branch is awarded Gold Medal. So in 2006-07 there were 7 students who were awarded Gold Medal in 7 branches. Subham Maheshwari was one of the 7 students.
Basis for distribution of marks under A, B, C, D, E. "A" This is obtained multiplying OGPA by 10 thereby obtained % of marks out of 100. Then this is divided by 2 to get marks out of 50. OGPA of Subham Maheshwari is 8.72 and OGPA of Ravi Kumar Sinha is 8.94. By the above calculation the marks under 'A' of Subham Maheshwari is 43.60 out of 50 and marks of Ravi Kumar Sinha is 44.70 out of 50. "B" The marks obtained under Physical Efficiency Test out of 10 is awarded under this category. The marks of Subham Maheshwari under Physical Efficiency Test (100 mts. Run, Long Jump, Shot Put) is 8 out of 10 marks of Ravi Kumar Sinha is 8 out of 10 marks are awarded actually on the basis of Physical Efficiency Test.
"C" Marks obtained (out of 20) in NSO/NCC/NSS/Yoga based on the performance of the student in the above Stream is awarded under this category. The evaluation is based on regular attendance, activity & performance of the student throughout his 4 years of stay at ISMU. Subham Maheshwari was an optee of NSS stream and he was awarded 16 out 20. Ravi Kumar Sinha was an optee of Yoga Stream and he was awarded 19 out of 20 by the committee under this category.
"D" The marks obtained in Extra Curricular Activities such as CSLS, Photographic Society, Music Society, Chayanika Sangh, Indoor games out of 10 is awarded in this category. This is based on the participation of the students in above activities. This mark is awarded by a committee in which all Teacher In-Charge of above activities are members. President of ISM Student Society is also a member as representative of students. In this activity Subham Maheshwari & Ravi Kumar Sinha were awarded 9.0 each out of 10. "E" The marks in this category is awarded by a committee on the conduct of the student. This is based on recommendation of the concerned Heads of Dept. Subham Maheshwari and Ravi Kumar Sinha were awarded 10 marks each out of 10 in 'E'. Adding A to E above Subham Maheshwari obtained 86.60 and Ravi Kumar Sinha obtained 90.70 out of 100. So the Best Student Shield was awarded to Sh. Ravi Kumar Sinha.
First Appellate Authority Ordered:
"In view of the above details it is very clear that all marks have been awarded based on evaluation of their teachers in charge respectively. All students are equal before the teachers and hence there is no basis for complaint of regionalism. Subham Maheshwari was equally liked by all teachers like other students. The university always takes pride in such students. However, the award of marks as explained above has to be accepted."
