(Moumita Maity Vs. The West Bengal Central School Service
                                  Commission & Ors.)

                   Mr. Debansu Biswas
                                                    .....For the petitioner

                   Mr. Saugata Bhattacharya
                                                    .....For the respdt. nos. 1 & 2

                   Mr. Debjit Mukherjee
                                                    .....For the respdt. no. 3

The petitioner alleges supersession by the candidates placed at

serial nos. 65, 66 and 67 of the combined merit list although he was

placed at serial no. 63. The candidates who allegedly superseded the

petitioner are of 'OBC(B)' category whereas the petitioner belongs to

'General' category. There is no merit in the contention of the petitioner.

I would have dismissed this writ petition but having regard to

another point of challenge that has been raised by the petitioner, i.e.

reservation for in-service candidates has not been maintained in

accordance with law, I propose to admit the writ petition on this limited

              point.

Affidavit-in-opposition be filed by the respondents within four

weeks from date; reply thereto, if any, be filed within two weeks thereafter.

Put up the writ petition in the monthly list of January, 2015 under the heading 'For Hearing'.
