Respondent Nos. 1 and 2 have already filed the counter affidavit.

Service of notice is complete on respondent Nos. 3 and 7 to 10 14:29:24 IST Reason: but none has entered appearance on their behalf.

On last date of hearing, Ld. Counsel for petitioners was submitted that Respondent Nos. 4 and 6 are alive and he was 2 directed to file affidavit/letter in this regard but till date he has not filed the same.

Today, Ld. Counsel for petitioner submits that after due verification it is found that Respondent Nos. 4 and 6 have expired. Ld. Counsel seeks and is given four weeks time to file application for substitution in respect of said respondents.

As per office report, Ld. Counsel for petitioner has filed application for substituted service through paper publication in respect of deceased respondent Nos. 4 and 6 and unserved respondent No.5. The same may be allowed only with respect of Respondent No.5 and dismissed qua Respondent Nos. 4 and 6.

List again on 10.2.2023.
