HON'BLE MR. JUSTICE MAHENDAR KUMAR GOYAL Order 07/08/2020 Learned counsel for the petitioners submitted that the controversy involved in the present writ petition is about treating the petitioners as Disqualified Directors under Section 164(2)(a) of the Companies Act, 2013. The petitioners have also sought direction to use their Director Identification Number (DIN) and Digital Signature Certificate for the purpose of filing their return. (2 of 2) [CW-8365/2020] Learned counsel for the petitioners submitted that the Division Bench of this Court in DB Civil Writ Petition No.4062/2019 (Narendra Kumar Jat Vs. Union of India) dated 09.07.2019 has already passed interim order and directions have been given to reactivate the Director Identification Number (DIN) and further Digital Signature Certificate is required to be issued in the capacity of the Director to file necessary annual returns to discharge statutory obligations of all the other companies wherein the petitioner is Director.
This Court, as an interim measure, directs the respondents to reactivate the Director Identification Number (DIN) of the petitioners and Digital Signature Certificate to enable the petitioners to file necessary annual return and also to discharge their statutory obligations.
The interim order, passed by this Court, will remain subject to final outcome of the present writ petition.
Let this case be listed before the Division Bench. Learned counsel for the petitioners is directed to file additional copy of the writ petition enabling Registry to list the matter before the Division Bench.
