Bench: Harish Tandon

23.03.2021 CRM 10070 of 2020
Court No.28
Item No.10 In Re:- An application for anticipatory bail under section 438 of the

Code of Criminal Procedure in connection with Hare Street Police akd Station Case No. 237 of 2020, dated 22.10.2020 under Sections 420/406/409/467/468/471/120B/506 of the Indian Penal Code.

And In the matter of : Suresh Chandra Nanda ...Petitioner Mr. Jaydeep Biswas, Mr. Soumyadeep Das, Mr. Kaushik Ghosh.

...For the Petitioner Mr. Ranabir Roy Chowdhury, Mr. Iqbal Kabir.

...For the State.

Mr. Sandipan Ganguly, Mr. Somopriya Chowdhury, Ms. Rekha Ghosh.

...For the de facto complainant.

The Advocate-on-record of the petitioner undertakes to affirm and stamp the petition / application as per the Rules within four weeks from date. Subject to such undertaking the application is taken up for hearing.

Petitioner says that there has been a substantial progress on the settlement with the de facto complainant and prays for some time, as there is every possibility of getting the matter settled.

The learned Counsel for the State opposes the prayer on the premise that the condition, which was imposed at the time of granting immunity from arrest, is being flouted and/or violated.

After hearing the learned Advocates of the respective parties and going through the materials on record as well as the nature of allegations made against the petitioner by the de facto complainant, we feel that another opportunity should be given so that the matter can be settled. However, we reiterate that the petitioner shall co- operate with the investigating officer and shall make himself 2 available as and when called for.

The matter is made returnable after three weeks.

The interim order granted earlier shall continue.
