Present case was burnt in the fire which broke out on 30.1.2011. The matter was widely reported in the press and appeals had been issued through general notice to the bar to supply copies of case papers to help the court to reconstruct files. Several counsel have cooperated in the exercise and supplied copies. Cases which are reconstructed are being posted for hearing but there are also many instances where paper books have not been supplied in spite of notices to counsel.
It has also been reported that the status of the case as to whether the case is pending or decided is also not available in computer as the same is not entered in the Mozilla. The case is brought for hearing with such limited information as it available. The cause list contains the case number, names of the parties/counsel but none has appeared at the time of calling.
Dismissed in default with liberty to revive petition as and when an application for restoration of the case along with paper book of the main case is filed. A copy of the order be sent to appellant(s) as well as to the counsel for the parties. The Court Master to ensure that disposal of the case is entered in the ISHICO (Mozilla). Case be consigned to record.
