Order 13/08/2018 By order dated 21.2.2018, it was noticed that counsel for the appellants did not want to press the application filed under Order XXII Rule 3 CPC for bringing on record the legal representatives of appellant No.1 and, therefore, the application was dismissed as not pressed.
Learned counsel for the appellants submits that as appellant No.2, a legal representative of appellant No.1, is already on record and the land in question has been purchased by him from appellant No.1, there was no necessity to bring on record other legal representatives of appellant No.1 on record.
In view of the submissions made, name of appellant No.1 is ordered to be deleted from the array of parties. Endorsement in this regard be made by the office in the cause title.
List the appeal for hearing on 30.10.2018.
