JUSTICE BIRENDRA KUMAR Order 04/08/2022 The prayer of the petitioner for second regular parole has been refused by the Competent Authority for the reason that under Parole Rules of 2021, the petitioner is not qualified to be released on parole.

Learned counsel for the petitioner submits that the petitioner was refused first regular parole also by the said Committee and vide order dated 13.08.2020 passed in S.B. Criminal Writ Petition (Downloaded on 25/12/2022 at 04:29:44 AM) (2 of 2) [CRLW-299/2022] No.469/2020, the refusal was set aside by this Court and the petitioner was allowed parole. The report at (Annex.1) would show that the petitioner has satisfactory report while serving out the sentence. In the matter of Khetaram @ Bhotiya Vs. State in S.B. Criminal Writ Petition No.366/2020 vide order dated 26.04.2022, a Co-ordinate Bench of this Court allowed 20 days parole to Khetaram vide order dated 26.04.2022 though Khetaram was also convicted for offence under Sections 7 & 8 of the POCSO Act.

Considering the facts aforesaid, it is directed that the petitioner be released on second regular parole for 20 days on furnishing of surety bond of Rs.1,00,000/- with two sureties of the like amount.

Petition stands allowed.
