ORDER
1. This original application was instituted by Prasoon Pant and Pradeep Kumar, applicants, under Section 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as 'NGT Act, 2010') raising a complaint against Hospitality Establishments like restaurants, hotels, malls, operating in District Ghaziabad without obtaining requisite consent under Water (Prevention and Control of Pollution) Act, 1974 (hereinafter referred to as Water Act, 1974') and Air (Prevention and Control of Pollution) Act, 1981 (hereinafter referred to as 'Air Act, 1981').
2. The applicant initially impleaded respondents 7 to 27, which are some of the hotels, restaurants and malls, and according to the applicants, were functioning without obtaining consent under the aforesaid Statutes.

Applicant stated that Ghaziabad is classified as 'critically polluted area' by Central Pollution Control Board (hereinafter referred to as 'CPCB'), based on Comprehensive Environment Pollution Index and one of the 'non-attainment cities', wherein level of PM10 from industrial and vehicular sources is amongst the highest in the country. Respondent 7 to 27 are hospitality entities running full fledged, eateries, restaurants, etc. and within the purview of directions given by this Tribunal vide order dated 04.02.2021 in O.A 400 of 2017, Westend Green Farm Society versus Union of India and others., wherein CPCB was asked to come up with a set of directions for complying with environmental norms by such eateries, hotels, banquets, food joints and restaurants. Under the guidelines of CPCB, individual eateries and restaurants on road sides with a minimum seating capacity of 36 people and also running 2 hospitality destinations such as hotels, banquets and malls, etc, or otherwise, are required to seek and obtain consent under the above Statutes from UP Pollution Control Board (hereinafter referred to as 'UPPCB') in addition to a host of other environmental authorizations. As most of these establishments have food courts and restaurants, being in their nature of business, these dining-out outlets are required to have environmental clearances as directed by Tribunal in aforementioned OA.
The 21 hospitality establishments impleaded in the application are in violation of the CPCB and UPPCB directions framed in the wake of NGT order in the aforementioned OA, as these do not have an NOC of State Pollution Control Board. Being in the vicinity of national capital, hospitality industry of Ghaziabad has s a high footfall of around 40-50 lakhs people a month that could be generating lots of air and water pollution and misuse of already stressed resources, such as groundwater.
Hence, it becomes all-the-more important that business establishments strictly follow the environmental norms.
4. Tribunal being prima facie satisfied that a substantial question relating to environment has arisen due to implementation of enactments is specified in schedule 1 to NGT Act, 2010, found it appropriate to issue notices initially only to respondents 1 and 2 requiring them to file their responses.
5. UPPCB through Regional Officer, Ghaziabad submitted its status report dated 05.07.2023 giving status of 20 banquets, hotels and malls with regard to 'consent' as under:-

6. It is also stated that in the matters where consent has not been obtained, notices have been issued to violators under Section 25/26 of Water Act, 1974 and Section 21 of Air Act, 1981 on 26.06.2023 requiring them to comply the mandatory provisions.

Further reply has been filed by CPCB vide email dated 04.09.2023 stating that, if there is violation of environmental statutes, action has to be taken by concerned Regulators in respective States/Union Territories in accordance with law. It is also said that CPCB has issued guidelines titled as 'Mechanism/ Guidelines for Control of Pollution and Enforcement of Environmental Norms at Individual Establishments and the Area/Cluster of Restaurants/Hotels/Motels/Banquets, etc.' in compliance of Tribunal's order dated 19.09.2019 in O.A 400 of 2017, Westend Green Farm Society vs. Union of India and others. Copy of the said guidelines are on record as annexure-6, page 53 of the paper book.
8. Above responses and reports were considered by Tribunal on 04.09.2023 wherein its was observed that certain establishments were operating without requisite statutory consent and there was clear violation but no effective action was taken by UPPCB without any valid reason.
9. Looking to the issues raised in the matter and also seriousness thereof, Tribunal directed UPPCB to conduct a survey and file additional status report giving specific information with regard to the following aspects:
(i) Number of malls, hotels, eateries and restaurants operating in District Ghaziabad required to obtain EC from SEIAA, if applicable and/or CTE/CTO from UPPCB with detailed particulars regarding name, location, boundaries, area etc.;

(ii) Number of such malls, hotels, eateries and restaurants operating in District Ghaziabad which have not obtained EC, if applicable from SEIAA and/or CTE/CTO from UPPCB; and
(iii) Details of Action Taken against such malls, hotels, eateries and restaurants operating in District Ghaziabad which have not obtained EC, if applicable, from SEIAA and/or CTE/CTO from UPPCB.
10. Pursuant to above order, UPPCB filed its status report dated 30.09.2023 stating that besides 21 establishments in respect whereof information was already given, 82 more sites were surveyed by the officials of UPPCB, whereof 24 have valid Consent to Operate and 58 have been issued notices to show cause as to why Environmental Compensation may not be imposed. List of 82 establishments is given in Annexure-3 to the report and their current status with regard to consent is given as under:-

11. Tribunal thereafter vide order dated 03.10.2023, issued notices to respondents 3 to 27 requiring them to file their reply. It also observed that Environmental Compensation sought to be imposed by UPPCB on 58 proponents was not consistent to the magnitude of capital investment/ assets required for operations to be carried out by those establishments etc. and therefore direction was given to revisit the same. Further, Tribunal directed to include 58 non-compliant proponents as respondents 28 to 85 vide order dated 19.12.2023.
12. UPPCB further submitted report in which details of 67 more units were given. They were impleaded as respondents 86 to 152 vide order dated 12.03.2023.
13. Presently, a status report dated 20.08.2024 has been filed by the UPPCB stating that out of 146 units i.e. respondent 07 to 152, 51 have valid consent under Water Act, 1974 and Air Act, 1981 and complying with the environment statutes. Details thereof are as under:-

18. Pursuant to notices issued to Proponents, respondents 138, 88, 129, 140, 141, 143, 10, 84, 20, 27, 125, 127 and 52 have filed their responses.
19. In view of the order which we propose to pass, we are not referring these responses in details in this order.
2620. We have heard learned counsel for parties and with consent of parties, we are deciding this matter.
21. In respect of the Proponents, their consent has already been obtained under the provisions of Water Act, 1974 and Air Act, 1981, as the case may be, there is no legal obstruction in their continuance and functioning. Therefore allow these units to function without any further obstruction subject to further requirement of renewal of consent, etc. as the case may be, which they will obtain in accordance with law whenever occasion arises. The establishment shall also observe and comply the consent conditions strictly. On this aspect, UPPCB shall make periodical inspections and monitor compliance of consent conditions in respect of the said proponents.
22. In respect of the proponents who have not obtained any consent till date, looking to the facts and circumstances and also the fact that in most of the cases, it is the lack of knowledge or information by the concerned proponents, we allow them three months' time to apply and obtain consent from the competent authority i.e. UPPCB. After three months, hospitality establishments who have not obtained consents shall not be allowed to operate. Appropriate orders for closure of such units shall be passed by the competent authority of UPPCB in accordance with law and actual closure shall be monitored effectively till the statutory consent is obtained by such Proponents and thereafter they would continue to comply with the consent conditions. With regard to such Proponents who failed to obtain consent within the time allowed by this Tribunal, competent authority of UPPCB shall also take punitive, preventive, prohibitive and remedial steps including, assessment and recovery of Environmental Compensation, expeditiously.
2723. In respect of the orders of Environmental Composition already passed by the UPPCB, we clarify that these orders are appealable under the relevant Statutes. Therefore, the aggrieved persons may avail such statutory remedy in accordance with law and this order shall not affect those orders already passed. However, in respect of the closure orders already passed, but later consent has been obtained, appropriate order to enable the such proponents to operate shall be passed by the competent authority of UPPCB in accordance with law without any further delay.
24. A compliance report shall be filed by UPPCB showing status as on 31.12.202 by 15.01.2025 before Registrar General of this Tribunal and if any further order is required, the matter shall be placed before the Bench concerned.
25. With the above directions/observations, this Original Application is disposed of.
26. A copy of this order be forwarded to UPPCB by email for compliance.
