                               O R D E R (in circulation)

1. This Review Application has been filed under Rule 22(3)(f) read with Rule 24 of CAT (Procedure) Rules, 1987 seeking review of the order dated 16.07.2025 passed in Original Application No.060/01191/2021.

2. The operative portion of the order dated 16.07.2025 reads as follows:-

"27. Accordingly, the Original Application is allowed. The impugned orders dated 06.09.2021 (Annexure A-30) and 27.09.2021 (Annexure A-31) are hereby quashed. The respondents are directed to extend to the applicants the same revised pay scales and benefits as have been granted to their counterparts at AIIMS, New Delhi, pursuant to the judgment dated 15.07.2015 in OA No. 3335/2011. They are further directed to implement the recommendations of the Coordination Committee as approved by the Governing Body of PGIMER without further delay and grant all consequential benefits, including arrears, within a period of three months from the date of receipt of a certified copy of this order. However, in the peculiar facts and circumstances of the case, we disallow the claim of the applicants for payment of interest on arrears of pay and allowances payable to them on account o grant of pay scales/Pay Bands with Grade Pay with retrospective effect."

That the impugned judgment dated 16.07.2025 suffers from an error apparent on the face of the record, as this Hon'ble Tribunal has directed implementation of the NEERU 2026.02.03 17:15:42 DOUGALL +05'30' 8 recommendations of the Coordination Committee despite there being no specific pleading or prayer to that effect in the Original Application, and notwithstanding the categorical rejection of such recommendations by the competent authority, namely the Ministry of Finance, Department of Expenditure, vide decision dated 17.11.2021. The Tribunal has thus granted relief beyond the scope of the pleadings, overlooked binding executive decisions having financial implications, failed to distinguish between the limited claim of parity with AIIMS pursuant to OA No. 3335/2011 and the much wider Coordination Committee recommendations, and ignored prior disposed cases on the same issue, rendering the impugned directions legally unsustainable and liable to be reviewed in the interest of justice.

From perusal of the order under review it is found that the case was disposed of after hearing the learned counsel of both sides and after perusal of the pleadings of the respective parties and no new ground has been taken up to review the order dated 16.07.2025. The review petition is a disguised appeal, seeking re-argument on merits and re- appreciation of findings, which is impermissible in review jurisdiction. No error apparent on the face of record is demonstrated. An error which is not self-evident and which can be discovered by a long process of reasoning, cannot be treated as an error apparent on the face of record justifying exercise of power under Section 22(3)(f).

5. Hon'ble Supreme Court in the matters of State of West Bengal and others Vs. Kamal Sengupta and another, (2008)2 SCC (L&S) 735 scanned various earlier judgments and summarized the principle laid down therein, which reads thus:

"35. The principles which can be culled out from the above-noted judgments are:
(i) The power of the Tribunal to review its order/decision under Section 22(3)(f) of the Act is akin/ analogous to the power of a civil court under Section 114 read with Order 47 Rule 1 CPC.
(ii) The Tribunal can review its decision on either of the grounds enumerated in Order 47 Rule 1 CPC.
(iii) The expression "any other sufficient reason"

appearing in Order 47 Rule 1 has to be interpreted in the light of other specified grounds.

(iv) An error which is not self-evident and which can be discovered by a long process of reasoning, cannot be treated as an error apparent on the face of record justifying exercise of power under Section 22(3)(f).

(v) An erroneous order/ decision cannot be corrected in the guise of exercise of power of review.

(vi) A decision/order cannot be reviewed under Section 22(3)(f) on the basis of subsequent decision/judgment of a coordinate or larger Bench of the tribunal or of a superior court.

(vii) While considering an application for review, the tribunal must confine its adjudication with reference to material which was available at the time of initial decision. The happening of some subsequent event or development cannot be taken note of for declaring the initial order/decision as vitiated by an error apparent.

(viii) Mere discovery of new or important matter or evidence is not sufficient ground for review. The party seeking review has also to show that such matter or evidence was not within its knowledge and even after the exercise of due diligence, the same NEERU 2026.02.03 17:15:42 DOUGALL +05'30' 10 could not be produced before the court/tribunal earlier."

7. We are, therefore, of the view that the law noticed hereinabove is squarely applicable in the present case and since no error apparent on the face of record has been pointed out or established, the present Review Application is misconceived and is liable to be dismissed.

8. In the result, there is no merit in the present Review to review our order dated 16.07.2025 and the same is accordingly dismissed.
