02. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with Kharia P.S. Case No.18 of 2025 pending on the file of learned Sessions Judge-cum- Special Judge, Balasore for commission of offences punishable under Sections 109/ 115(2)/ 118(1)/ 296/ 351(3)/ 3(5) of B.N.S., 2023 read with Section 3(1)(r) of the SC & ST (POA) Act, 1989.

3. It is submitted by the learned counsel for the Petitioner that exaggerated allegations has been made. Hence, the Petitioner may be protected by pre- arrest bail.

4. Learned counsel for the State submits that there is no external injury and it is his further Page 1 of 2 submission that the Petitioner is cited as an accused in the following four cases:-

"(i) Khaira P.S. Case No.33 Dt.25.02.2011, U/s 294/337/353/379/506/34 IPC
(ii) Khaira P.S. Case No.4 Dt.16.07.2015, U/s 294/323/341/342/353/448/506/34 IPC
(iii) Khaira P.S. Case No.58 Dt.01.03.2025, U/s 303(2)/317(2)/3(5) BNS read with Section 51(1)(a) of OMMC Rules
(iv) Khaira P.S. Case No.252 Dt.19.08.2025, U/s 115(2)/126(2)/296/109/351(2)/3(5) BNS read with Section 3(1)(r)(s)/3(2)(va) SC/ST (PoA) Act."

5. Considering the nature of allegations coupled with the criminal antecedents, this Court is not inclined to grant the exceptional remedy of pre-arrest bail to the Petitioner. However, in the event the Petitioner surrenders before the learned Court in seisin in the aforesaid case and moves an application for his release on bail, the same shall be considered on its own merit.

6. The ABLAPL is accordingly disposed of.
