(2)A probationer in any category of a service or class of a service shall be eligible to count for probation, his service, if any, performed otherwise than in substantive capacity on regular appointment to a higher category of the same service or class of service, as the case may be:Provided that nothing contained in this sub-section shall be construed as authorising the promotion of a probationer in a category to a higher category in contravention of section 41.
