Heard on I.A.No.18359/2018, an application for condonation of delay. T he appeal filed by the appellants No. 1 & 2 against their conviction and sentence under Sections 370/34, 120-B of Indian Penal Code & Section 3(2)(v) of SC/ST (Prevention of Atrocities Act) & Section 376(2)(n), 120(B) of Indian Penal Code, Section 5/6 of POCSO Act and Section 3(2)(v) of SC/ST (Prevention of Atrocities) Act, respectively, is barred by 29 days.
On due consideration and for the reasons assigned in the application, so also the fact that by impugned judgment appellants have been convicted for life imprisonment, in the interest of justice, we are of the view that the cause shown by the appellants for the delay of 29 days in filing the appeal is sufficient to condone the same.
Accordingly, I.A.No.18359/2018 is allowed and delay of 55 days in filing the appeal is hereby, condoned.
Heard on the question of admission.
Appeal being arguable is admitted for final hearing. Shri S.K. Rai, learned Govt. Advocate accepts notice on behalf of the respondent-State.
