                       ORDER

% 09.04.2021 The hearing has been conducted through video conferencing.

1. By this petition, petitioner is seeking interim bail for 30 days to enable him to get the surgery of both his ears done. Petitioner is in custody in FIR No. 383/2013, under Section 302 IPC, registered at police station Burari.

2. In compliance of last order, learned Additional Public Prosecutor for State has placed on record report dated 08.04.2021 by the Medical Officer- in-charge, Central Jail Hospital & Dispensary, Central Jail No.03, Tihar, New Delhi.

3. In the report it is stated that despite several announcements on 22.02.2021, petitioner did not present himself before the Jail Senior Resident ENT for review and was subsequently taken to ENT department of Deen Dayal Upadhyay Hospital, where he was reviewed and examined by a Senior Resident ENT. His pure tone audiometry and otoendoscopy test were done and thereupon opined that his general condition and vitals are stable and satisfactory and all prescribed medicines are provided at Jail Dispensary itself.

4. In view of the aforesaid status report, I am not inclined to allow this petition.

5. The petition is accordingly dismissed.
